AGREEMENT FOR VOLUNTARY RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

I request permission to participate in fox hunting activities with the Andrews Bridge Foxhounds, Inc., including the social activities associated therewith, subject to the rules and regulations thereof.

I fully understand that equine activities, including cross-country horseback riding and fox hunting (which include riding over fences, other obstacles, and dangerous and rough terrain), are very dangerous activities. I have observed these activities and wish to participate in the activities knowing that they are inherently dangerous, that I may be kicked, fall, hit a fixed object or be otherwise injured and that other participants pose a danger to me. WITH THIS KNOWLEDGE, I FULLY APPRECIATE AND VOLUNTARILY ACCEPT AND ASSUME ALL THE RISKS OF INJURY (INCLUDING DEATH) TO ME OR MY PROPERTY FROM PARTICIPATING IN THESE ACTIVITIES.

In consideration of being permitted to participate in fox hunting and social activities with Andrews Bridge Foxhounds, Inc., for myself, my heirs, guardians, and legal representatives, I RELEASE AND AGREE IN ADVANCE NOT TO MAKE OR BRING ANY CLAIM OF ANY KIND AGAINST ANDREWS BRIDGE FOXHOUNDS, INC., OR ITS MASTERS, DIRECTORS, OFFICERS, MEMBERS, EMPLOYEES AND/OR GUESTS OR ANY LAND OWNERS, LANDHOLDERS OR OTHER PERSONS MAKING PROPERTY AVAILABLE FOR THE ANDREWS BRIDGE FOXHOUNDS, INC. (the “Releasees”), for any injury (including death), to me or any damage to my property whether from anyone's negligence or not, or any other cause, arising out of my participation in these dangerous horseback riding, fox hunting or related social activities; regardless of the legal basis for such claim or liability. I hereby covenant to hold Releasees harmless and indemnify Releasees for any claim, action, judgment or expenses (including reasonable attorney’s fees) Releasees may incur arising out of my participation in Andrews Bridge Foxhounds, Inc.’s activities.

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that, by participating in a foxhunt or related activities, I may be exposed to or be infected by COVID-19 and that such exposure or infection may result in severe illness, permanent disability and death. I agree to assume all of the foregoing risks and accept sole responsibility for any illness that I may experience or incur in connection with participation in a foxhunt or related activities.

By signing, I also consent that photo images taken during this activity may be used in any or all Andrews Bridge Foxhounds publications and social media platforms.

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. I agree that this Agreement is intended to be as broad and inclusive as is permitted by the law of the Commonwealth of Pennsylvania and that, if any portion thereof is held invalid, it is agreed that the balance shall continue in full legal force and effect.

FURTHER, I CERTIFY AS FOLLOWS: (i) I HAVE READ THIS DOCUMENT; (ii) I UNDERSTAND IT IS A RELEASE OF ALL CLAIMS; AND (iii) I UNDERSTAND THAT I ASSUME ALL RISKS OF ANDREWS BRIDGE FOXHOUNDS, INC. ACTIVITIES.

I VOLUNTARILY SIGN MY NAME, EVIDENCING MY ACCEPTANCE OF THE ABOVE PROVISIONS.

NOTE: Any child under eighteen (18) years of age must have their name listed and their parents or guardians must sign the form to give permission for their child to participate in cross-country riding and fox hunting.
