LIABILITY RELEASE
ASSUMPTION OF RISK AND REPRESENTATION. The Participant understands, is aware of, and assumes all risks inherent in participating in the Ministry Event. These risks include those listed on Exhibit A, but are not limited to the hazards of road transportation, service projects, construction projects, illness or accident without immediate access to medical facilities, and the forces of nature. Any of such activities may result in serious bodily injury or death. The Participant represents that he/she possesses the necessary skills and fitness to participate in these activities safely and without super-vision.
RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE. The Participant and/or his or her personal representatives, assignees, insurer, heirs, executors, administrators, spouse and next of kin, hereby releases, waives, discharges and covenants not to sue FIRST BAPTIST CHURCH ROANOKE, a Texas nonprofit corporation (herein referred to as “Church”), and its directors, officers, employees, agents, volunteers, as well as its successors, assigns, affiliates, subordinates, and subsidiaries; and releases, waives and/or discharges all of the above from any and all liability to its as-signs, insurers, heirs, executors, administrators, spouses and next of kin for any and all loss, damage, or cost on account of injury to the Participant or his or her property, whether caused by negligence, or otherwise, while the Participant is participating in the ministry event and any other activities in connection therewith.
INDEMNITY. The Participant agrees to indemnify Church from any liability, loss, damage or cost that may incur due to the participation by the Participant in the Ministry Event, whether caused by the negligence of Church, or otherwise. The participant assumes full responsibility for, and risk of, bodily injury, death or property damage due to the negligence of other participants in the ministry event, or otherwise, while participating in the ministry event.
ARBITRATION. If a dispute over this agreement or any claim for damages arises, the Participant (or parent/guardian) agrees to resolve the matter through a mutually acceptable alternative dispute resolution process. If the Participant (or parent/guardian) and the Church cannot agree upon such a process, the dispute will be submitted to a three-member arbitration panel of the Institute for Christian Conciliation for final resolution. The Participant expressly agrees that this Assumption of Risk, Voluntary Release, and Indemnity Agreement (herein referred to as the “Agreement”), is intended to be as broad and inclusive as permitted by the laws of the State of Texas and that, if any portion of this Agreement is held invalid, it is agreed that the balance, notwithstanding, shall continue in full legal force and effect.
