In consideration of being permitted to participate in any way in the fitness/marital arts program indicated below and/or being permitted to enter for any purpose any restricted area (here in defined as any area where in admittance to the general public is prohibited), the adult participant,  parent(s) and/or legal guardians of a minor participant named below agree: 1. I/we fully understand and acknowledge that there are risks and dangers associated with participation in fitness/martial arts events and activities which could result in bodily injury, partial and or total disability, paralysis and/or death. 2. I/we accept and assume such risks and responsibility for the losses and damages following such injury, disability, paralysis or death, however caused and whether caused in whole or in part by the negligence of the releases named below. 3. I/we  hereby release, waive, discharge and covenant not to sue VO2 Fitness, including its owners, managers, promoters, lessees of premises used to conduct the fitness/martial arts event or program, premises and event inspectors, underwriters, consultants and others who give recommendations, directions or instructions to engage in risk evaluation or loss control activities regarding VO2 Fitness or referred to as “release”…from all liability to the undersigned, my/our personal representatives, assigns, executors, heirs and next of kin for any and all claims, demands, losses or damages and any claims or demands therefore on account of any injury, including but not limited to the death of the participant or damage to property, arising out of or relating to the events(s) caused alleged to be caused in whole or in part by the negligence of the release or otherwise. 4. I/we hereby acknowledge that the activities of the events are very dangerous and involve the risk of serious injury and/or death and/or property damage. Each of the undersigned also expressly acknowledges that injuries received may be compounded or increase by negligent rescue operations or procedures of the releasees. 5. Each of the undersigned further expressly agrees that the foregoing release, waive and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the Province or State in which the event is conducted and that if any portion is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect. 6. On the behalf of the participant and individually, the undersigned partner(s) and or legal guardians for the minor participant executes this waiver and release. If, despite the release, the participant makes a claim against any of the Releasees, the parent(s) and/or legal guardians will reimburse the Releasee for any money which they have paid to the participant, or on his behalf -  and hold them harmless. *

Covid-19 Waiver: Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. VO2 Fitness has put in place preventative measures to reduce the spread of COVID-19; however, VO2 Fitness cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending VO2 Fitness could increase your risk and your child(ren)’s risk of contracting COVID-19.By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed to or infected by COVID-19 by attending VO2 Fitness and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the VO2 Fitness may result from the actions, omissions, or negligence of myself and others, including, but not limited to, VO2 Fitness employees, volunteers, and program participants and their families.I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at the VO2 Fitness. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless VO2 Fitness, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Club, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any VO2 Fitness program. *

I FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE THE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTEND ALLOWED BY LAW. *
