DSA and DMA Survey
As with any economic sector that matures, the growth of the digital economy brings new opportunities and challenges. The European Commission presented new regulation proposals, the Digital Markets Acts (DMA) and the Digital Service Act (DSA) to try and address these challenges while harmonizing the European market in the process.

The Digital Services Act seeks to update the E-Commerce Directive and provide a framework for intermediary liability/due diligence and The Digital Markets Act seeks to drive economic recovery and strengthen the local market

On the Digital Markets Act (DMA)
Following the Commission's proposal, digital markets are not sufficiently contestable. The DMA proposal will therefore identify the biggest players (so-called gatekeepers) and introduce prohibitions and obligations for them. The criteria used to identify gatekeepers are based on turnover, users, amount of markets and time period.

The European Commission has proposed a series of new regulations for the digital sector recently. One of them is the Digital Markets Act which aims to create a special set of strict rules for the most successful tech companies in terms of users, turnover and products.

According to Crunchbase data, global venture funding hit an all-time high in the first quarter of 2021, with Europe presenting a stellar performance. For startups, the ability to exit or be acquired is an important part of their strategy/lifecycle. Numerous provisions in the DMA could make it harder for so-called gatekeepers to acquire  startups.  In your understanding, could the DMA impair VC ability to support EU start-ups to grow or to compete globally?

The DMA is oriented towards specific use cases, rather than principles. For example, it assumes that the use of data to scale into other verticals is harmful and should be banned. Another example is that companies that are in scope, will have to share some of their data with competitors. Should the DMA apply to all actors in the digital market?

In addressing specific use cases the DMA aims to ban gatekeepers from all activities that fall under these cases. Past experience has shown that in some cases, these activities can have positive effects on consumers, competition or innovation. Should companies have the possibility to prove the positive effects of their technology ?

The EC provides a series of criteria to be a gatekeeper, like the number of business users, turnover, and being active in +3 markets. But it also says that it would reserve the right to designate  smaller companies as emerging gatekeepers if they have an entrenched position in a given market. Do you believe the scope and definitions are  clear enough, through a scale-up / growth perspective?

On the Digital Service Act (DSA):
The DSA addresses the issues of transparency, user safety, and liability issues by (1) supervising all intermediaries (e.g. hosting sites, catching providers, etc) in digital services, (2) creating ‘special rules’ for very large digital platforms. The Commission targets several players in the industry, from intermediaries and caching providers, to hosting sites and online platforms.
