Live deeply Affiliate Partner Agreement.

The following terms and conditions are a legal agreement between Live deeply and you ("affiliate"). By signing up to be an affiliate in the Live deeply Program ("program") you agree to be bound by the following terms and conditions. Kindly read them in full before signing up.

Definitions:

Agreement - the contract between you and Live deeply and when signing up to become an affiliate and joining the program
Program - The affiliate program as set out on the website and is bound by this Agreement
Affiliate - Party who agrees to the terms of this agreement
Link - a HTML link that the Affiliate will receive to link the Affiliate's website to the Site
Site - www.welivedeeply.com website

1. The Agreement

1.1. An Affiliate is to provide their full legal name, valid address, e-mail address, PayPal account, and any other requested information truthfully in order to create an Affiliate account.

1.2. An Affiliate must provide a valid PayPal address that will be used to receive commission payments.

1.3. Live deeply reserves the right to update and change the Terms from time to time without notice.

1.4. Any changes to the Program shall be subject to these terms.

1.5. The Program shall not be used for any illegal or unauthorized purpose.

Violation of these terms and conditions may result in suspension of your rights to be an Affiliate and result in lost commissions and/or removal from the Program.

2. Modification of Live deeply affiliate program terms and conditions

Live deeply reserves the right to modify and change the terms of the agreement at any time. It is the responsibility of the affiliate to check back on the terms occasionally. In the event that the affiliate does not accept any changes, the option for the affiliate is to terminate their enrollment in the program.

3. Affiliate account

In order to enter the Intelligent Change Affiliate Program (Hosted by Refersion), the affiliate is required to create an account with a login and password. From this Refersion account, the affiliate is able to track and view their sales on their own personal dashboard.

4. Accepted methods of advertising

4.1. Affiliates are permitted to use resources such as links, discount codes, any related banners, and/or text advertisements provided by the Live deeply Affiliate program.

4.2. Affiliates are not permitted to promote any non-affiliate program-related discounts and coupon codes that are found in customer newsletters, the Live deeply website, other third-party websites, and from any source other than directly from the Live deeply affiliate program.

4.3. The promotion should include the offer, discount code, link provided by the Live deeply affiliate program and expiration date.

4.4. Affiliates must remove invalid or expired codes and banners.

4.5. Affiliate coupon codes and links are not permitted to be promoted on third-party websites such as coupon databases.

4.6. Affiliates are permitted to promote their coupon code and link on their own social media accounts only. Affiliates are not permitted to share this information on any Live deeply social pages. 

4.7. It is strictly forbidden to use Live deeply's trademark along with your affiliate link on any paid advertising channels.

4.8. Sales that have been generated from improper promotion will result in loss of commission.

4.9. Live deeply reserves the right to take legal action against any affiliate that commits fraud.

4.10. From time to time, affiliate codes may be changed. Affiliates will be contacted with their new code and all old codes must be removed and replaced with the new discount code. 

5. Copyrighted material

The Affiliate is responsible for ensuring that product descriptions and images comply with all applicable copyright, trademark, data protection, any intellectual property right, or any other applicable law. Live deeply will not be responsible if an affiliate uses another party's copyrighted material in violation of the law.

6. Payments

6.1. Affiliates receive a commission for sending authorized sales via unique Refersion links provided by Live deeply Program. In order to receive a commission, the referred customer is required to complete their purchase by clicking through the affiliates link within 30 days of the initial click-through.

6.2. The commission is based only on the product purchased. Payments will be made monthly, on the first of every month (or the next business day thereafter).

6.3. Payout rates may change and they can be viewed by logging into the affiliate's account. 

6.4. It is the affiliate's responsibility to determine if the payout for the link provided has been discontinued.

6.5. As the commission is paid only on links that can be tracked and reported by Live deeply affiliate program systems, the referred customer must have cookies enabled in order to track the referral.

6.6. Refunded payments are excluded from receiving a commission payment.

6.7. Payments may be revoked in the circumstance that a code is leaked on third-party websites. It is the responsibility of the affiliate to ensure their code is not being exploited outside of their own personal channels.

7. Live deeply Obligations

Live deeply agrees to agree to the following obligations:

7.1. Providing the affiliate with promotional material and resources, such as links, coupon codes, banners, and any other graphic materials.

7.2. Processing all orders for Live deeply products placed by the affiliate's link.

7.3. Tracking the sales generated through the affiliate’s link and all social media content via provided tags and mentions.

7.4. Live deeply will provide payment processing, cancellations, returns, and other related customer support for the referred customer's order.

7.5 Provide one new product to the affiliate 2 times per year or every 6 months if needed.

8. Affiliate Obligations

8.1. Affiliates are requested to post one piece of unique and original content featuring our products on their social media platforms twice a quarter (every 3 months).

8.2. One piece of content can include the following items: Instagram stories (2+ frames),  Instagram feed posts, Instagram TV post, Facebook post, Youtube video or post, Tik Tok post, blog post, podcast feature, and any other content approved by Live deeply.

8.3. Instagram content must tag @fiveminutejournal, @beproductive and/or @welivedeeply (depending on the product being promoted) on the photo and in the caption, in addition to the hashtag #toolsforpositivechange, in order for Live deeply to track all content created. Youtube and blog content must link back to the Live deeply website (www.welivedeeply.com).

8.4. Affiliate must be following @fiveminutejournal, @welivedeeply, and @beproductive. 

8.5. Failure to follow affiliate obligations may result in affiliate content being missed and possible removal from the program.

8.6. Affiliate removal will take place if affiliates fail to comply with the content requirements outlined in this agreement.

9. The License

9.1. Live deeply grants to the Affiliate a non-exclusive, non-transferable, revocable right to access the Live deeply site through the link in accordance with the terms of this agreement and in connection with the promotional materials provided and authorized by Live deeply.

9.2 Live deeply is permitted to use Affiliate content on social media, website, and, ads. Credit will always be given accordingly.

9.3. Affiliates are not allowed to modify or change materials provided by Live deeply in any way.

9.4. Both parties agree to not use each other's materials in any manner that is misleading, disparaging, or defaming in any way.

9.5. Inappropriate use of the provided promotional material may be cause for immediate termination of the agreement.

10. Liability

Live deeply will not be liable to the Affiliate for the defects in the service, interruptions in the accessibility to the service, loss of data on the information handling system or viruses, loss of profits, loss caused by any third party deleting, removing, deactivating or tampering with the Affiliate tracking service or other consequential loss of whether arising from neglect or breach of contract.

11. Termination

The term of the agreement starts upon Live deeply affiliate program acceptance of affiliate's application and can be terminated by either party. Affiliation can be ended with or without cause at any time, by giving the other party notice of termination in the form of an e-mail. Upon the termination of the agreement, the affiliate will remove all links to the Live deeply website, as well as all banners and graphic images provided under the Program.
