I, as a guardian of a camper on behalf of my child, hereby acknowledge and agree to the terms outlined in this Liability Waiver ("Waiver") in consideration for my child being permitted to participate in Mahoosuc Kids Association's Summer Adventure Program ("Program").
Assumption of Risks:
I understand that the Program may involve certain activities that inherently carry risks, including but not limited to swimming, hiking, riding a school bus, playing on the playground, walking into town, and other recreational activities ("Activities"). I acknowledge that these Activities may expose my child to risks of bodily injury, property damage, or other harm, including but not limited to falls, collisions, drowning, and encounters with wildlife.
Responsibility for Child's Safety:
I agree to ensure that my child exercises reasonable caution and care during their participation in the Program. I understand that it is my responsibility to assess and communicate my child's capabilities and limitations to ensure their personal safety and the safety of others.
Waiver of Liability:
In consideration for my child being permitted to participate in the Program, I hereby release, waive, discharge, and covenant not to sue Mahoosuc Kids Association its directors, officers, employees, volunteers, agents, and representatives (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by my child or to any property belonging to my child, whether caused by the negligence of the Released Parties or otherwise, while my child is participating in the Program or any Activities associated with it.
Indemnification:
I agree to indemnify and hold harmless the Released Parties from any and all liabilities, damages, costs, or expenses, including reasonable attorney's fees, arising out of or related to my child's participation in the Program or any breach of this Waiver.
Medical Treatment Authorization:
In the event of an injury or medical emergency involving my child, I authorize the Organization and its representatives to obtain medical treatment for my child as deemed necessary. I understand that the Organization will make reasonable efforts to contact me or the emergency contact listed on my child's registration form but may proceed with medical treatment if unable to do so.
Severability:
I intend for this Waiver to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
Governing Law:
This Waiver shall be governed by and construed in accordance with Maine state laws without regard to its conflict of law principles.
