Yoga Waiver Form
READ BEFORE SIGNING
Waiver & Release:
1) I represent that I am physically capable of participating in any and all activities provided by Portland Bach Experience, which may include, but not be limited to, yoga postures, exercise, meditation, outdoor activities, acrobatics, stretching and breathing exercises (the “Activities”). I understand that the Activities can be strenuous and subject to risk of serious injury and undertake participation in the Activities ENTIRELY AT MY OWN RISK. I understand that the Activities should not be undertaken without the consent of a medical doctor and I am responsible for undertaking to obtain such consent. I further take full responsibility for knowing and acting within my abilities while participating in the Activities and learning and implementing any modifications needed to make the Activities safe and appropriate for me. I agree that I alone am responsible for my safety while participating in the Activities.
2) I agree Portland Bach Experience and its directors, officers, employees, contractors, agents and assigns shall not be liable or responsible for any injuries to me which may occur as a result of (a) my use of any amenities and equipment provided by Portland Bach Experience and my participation in the Activities, (b) the sudden and unforeseen malfunctioning of any equipment and (c) my slipping and/or falling while in the facility, or on Portland Bach Experience premises, including adjacent sidewalk areas. I agree that Portland Bach Experience is also not responsible for any loss of or damage to, personal property. I HEREBY AGREE AND PROMISE TO ACCEPT AND VOLUNTARILY ASSUME ALL RISKS existing in the Activities. My participation in the Activities is purely voluntary and I elect to participate in the Activities in spite of any and all risks.
3) I, on behalf of myself, my heirs and for anyone on my behalf, to the fullest extent allowed by law, expressly agree to RELEASE, INDEMNIFY AND HOLD HARMLESS Portland Bach Experience and its directors, officers, employees, agents, contractors, affiliates, representatives, successors, assigns and instructors (the “Releasees”) from any and all claims, causes of action, legal liability or judgments that may arise out of the Activities, whether such claims were forseeable, including any claims of breach of conduct or other legal theory, and including NEGLIGENCE.
4) I HEREBY AGREE AND PROMISE TO NOT SUE AND TO INDEMNIFY, HOLD HARMLESS AND DEFEND RELEASEES for any claim of injury, damage or death which may occurring from my participating in the Activities, including any claims based on alleged NEGLIGENCE of Releasees. Should any claim or action be asserted in contravention of this agreement, I or my successor shall be liable for all expenses, including legal fees, incurred by Releasees.
I have carefully read this agreement, fully understand and agree to its terms, and understand this is a COMPREHENSIVE RELEASE OF ALL LEGAL LIABILITY, binding upon me, my heirs, agents and assigns, that it is not intended to assert any claims or defenses that are prohibited by law, and that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effective. I also agree that if a claim or action is brought, it shall be submitted to the jurisdiction of the State or Federal Court in the State of Maine, and no other jurisdiction, and shall be governed by the laws of the State of Maine.
I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
