[URGENT UPDATE]: Due to legal and organizing efforts, Kim San Mak was able to remain in the US and not be put on the scheduled deportation flight to Cambodia with the 25 Cambodian Americans on Monday, January 13th! However, he is still vulnerable for deportation.

We are calling on community members to please support Kim San Mak and his family, as the family and organizers are fighting to keep him here in Massachusetts. My name is ____________, and I am calling as a (community member/part of an organization/etc). I oppose the mass deportations targeting the Southeast Asian community by the Trump administration. Mr. Kim San Mak is a loving partner, father and grandfather, and he deserves justice and the due process that was denied him. I want Mr. Kim San Mak to remain here in Massachusetts with his family and community. So, I am calling to ask District Attorney Rachael Rollins to NOT oppose Mr. Mak’s Motion for New Trial.

[BACKGROUND] Kim San Mak came to the US in 1981 as a refugee fleeing the Khmer Rouge genocide, during which his parents, three siblings, and young daughter all died. Mr. Mak rebuilt his entire life in his community of Lowell, Massachusetts. He has spent his retirement as a loving grandfather to nine grandchildren, who he plays with, dotes on, and picks up from school. He has also supported his US citizen partner of 25 years through her three separate battles with breast cancer. Moreover, Mr. Mak has sought support for his post-traumatic stress disorder and major depression, which resulted from the extreme trauma of life under the Khmer Rouge regime.

Mr. Mak’s lawyer filed a Motion for New Trial on November 18th, because Mr. Mak was denied due process in his criminal case. His former defense attorney incorrectly told him there would be no immigration consequences if he took a guilty plea. There is also evidence that Mr. Mak was not competent to stand trial when he took that plea. This is an injustice that must be corrected.

Mr. Mak was scheduled to be deported along with the 25 other Cambodian Americans on January 13th. However, the Immigration Judge granted Mr. Mak’s Emergency Motion to Stay. We are excited that Mr. Mak is able to remain here in the US for a little longer, because it means we can continue to show up for him and his family. But we know time is limited. As long as Mr. Mak has a deportation order, him and his family will continue to live in a state of limbo, never knowing if or when he will be deported to Cambodia. We need the District Attorney Rachael Rollins to support the Southeast Asian community as they are facing continued targeting for mass detentions and deportations.

[THE ASK] Deportation is inhumane, and we cannot condone this injustice. We want to keep Mr. Mak here in the United States. With utmost urgency, I am asking District Attorney Rachael Rollins to NOT oppose the Motion for New Trial in Mr. Mak’s case.
