I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING AND/OR VOLUNTEERING IN PACIFIC GRAVITY HOMEBREWERS CLUB, including, without limitation, any risks that may arise from negligence or carelessness on the part of the Released Parties/Indemnitees (as defined below), from dangerous or defective equipment or property owned, maintained, or controlled by the Released Parties/Indemnitees, or because of their possible liability without fault.

I acknowledge that this Liability Waiver and Indemnification Agreement is a prerequisite to my membership in Pacific Gravity Homebrewers Club, and that it will govern my actions and responsibilities at club activities or events. In consideration of my application and permitting me to participate in Pacific Gravity Homebrewers Club events and activities, I hereby agree, on behalf of myself and my executors, administrators, heirs, next of kin, successors, and assigns, as follows:

(A) I HEREBY WAIVE, RELEASE, DISCHARGE, AND PROMISE NOT TO BRING LEGAL ACTION AGAINST, Pacific Gravity Homebrewers Club and its directors, officers, members, associates, volunteers, representatives, and agents (collectively, “Released Parties/Indemnitees”) from any and all claims, liabilities, losses, damages, and/or injuries (collectively, “Losses”) that may arise from my participation or attendance at club events or activities (and/or from my travel to/from club events or activities), including, without limitation, Losses arising from the negligence or fault of the Released Parties/Indemnitees, death, disability, personal injury, property damage, or property theft.

(B) I HEREBY ACKNOWLEDGE that the Released Parties/Indemnitees are not responsible for errors, actions, and/or omissions of any person or entity that conducts any event or activity on behalf of Pacific Gravity Homebrewers Club or any event or activity in which Pacific Gravity Homebrewers Club members participate.

(C) I HEREBY AGREE INDEMNIFY, DEFEND, HOLD HARMLESS the Released Parties/Indemnitees from any and all Losses that may be suffered or incurred by Released Parties/Indemnitees, to the extent such Losses arise from my errors, actions, and/or omissions at Pacific Gravity Homebrewers Club events and activities.

I acknowledge that I have received and reviewed, and agree to abide by, the Articles of Incorporation, the Bylaws, and any other applicable rules governing the conduct of Associates of Pacific Gravity Homebrewers Club.

I certify that I am physically fit, have sufficient knowledge of basic brewing principles and am aware of the inherent dangers of participating in Pacific Gravity Homebrewers Club related events and activities. I understand that my participation in Pacific Gravity Homebrewers Club is entirely voluntary, that participation in club events and activities involves the consumption of alcoholic beverages, and that such consumption my affect my perception and reactions. I accept sole responsibility for my conduct, behavior and actions. I further certify that I am of legal drinking age in the State of California.
