4. Cancellation and Non-Payment - The purchaser and DJ X agree that this contract is not subject to cancellation unless DJ X agrees to such cancellation. Due to the many events DJ X has been booked for, in the event the Purchaser breaches the contract or cancels the event, he/she shall pay DJ X the full amount set forth above immediately. All balances are due no later than 24 hours after cancellation before legal actions are then taken. Purchaser agrees after signing contract, not to disparage or defame DJ X in any respect or to make any derogatory comments, whether written or oral, regarding DJ X or its current or contracting parties, or its business or operations if the event is canceled or a disagreement arises in any manner. Defamation of any sort will result in legal matters going forward. (Ex: social media, website reviews, etc.)

(Cancellation and Non-Payment Continued) If payment is not received the Monday before the of the event, DJ X retains the right to end all services immediately and attempt collection through the courts. Purchaser will be held responsible for all court fees, attorney fees, legal fees, and collection costs incurred by DJ X. Each notice in writing (electronic or mail) is subject to a $125 charge paid by purchaser.

5. Laws and Court Procedures - By executing this contract as Purchaser, the person executing said contract, either individually, or as an agent or representative, represents and warrants that he or she is eighteen (18) years of age, and further, if executing said contract as agent or representative, that he or she has the authority to enter into this agreement and should he or she not have such authority, he or she personally accepts and assumes full responsibility and liability under the terms of this contract. The Laws of the State of Texas shall govern this agreement. Purchaser agrees to defend, indemnify, assume liability for and hold DJ X harmless from any claims, damages, losses and expenses by or to any person, regardless of the basis, which pertains directly or indirectly to DJ X performance. If a civil action arises, to enforce any provision of this agreement, the purchaser shall pay the attorney's fee and court costs of DJ X. Any changes must be written and signed. If any clause in this agreement is found to be illegal, the rest of the agreement shall remain in force. DJ X may elect not to exercise his rights as specified in this agreement. By doing so, DJ X does not waive his right to exercise those options at a future date. Purchaser may not transfer this contract to another party. This agreement is not binding until signed by Purchaser and DJ X has received it. Oral agreements are non-binding. The agreement of DJ X to perform is subject to proven detention by accidents, riots, strikes, epidemics, acts of God, or any other legitimate conditions. DJ X isn’t liable for indirect or consequential damages arising from any breach of contract. In the event DJ X is not able to play due to illness or a life threatening self or immediate family issue, DJ X will substitute a DJ to take his place if possible. DJ X is not in breach of contract due to acts of God beyond his control. This contract cannot be modified in any way.
