Use of ESEA Funds to Meet Identified Nonpublic Student Needs                                                          
A Planning Template for Nonpublic Schools
Section 8501(c)(1) of the Elementary and Secondary Education Act of 1965 (ESEA) requires that LEAs consult with appropriate nonpublic school officials.  One required topic of consultation is to determine how funded services will be assessed and how the results of the assessment will be used to improve services in the future.  This sample form is designed to be used by the LEA during consultation to collect the required programmatic information from the nonpublic schools, and to ensure the use of ESEA funds generated for equitable services are “necessary” and “reasonable” as required in federal regulation (2 CFR § 200.403 - Factors affecting allowability of costs)

This is a sample form that can be used in its entirety or edited to meet the unique needs of the LEA and nonpublic school.  The completed form should be kept on file at the district level.

Title I funding Needs for Jackson Students at Nonpublic Schools
The purpose of Title I of the ESEA is to provide all children significant opportunity to receive a
fair, equitable, and high-quality education and to close educational achievement gaps. (ESEA
section 1001). Each LEA that receives Title I funds identifies public school attendance areas and
schools that have high concentrations of children from low-income families as eligible to participate
in Title I programs. (ESEA section 1113).

ESEA section 1117 requires participating LEAs, in consultation with appropriate private school
officials, to provide eligible children attending private non-profit elementary and secondary schools,
their teachers, and their families with Title I services or other benefits that are equitable to those
provided to eligible public school children, their teachers, and their families. Eligible private school
children are children who reside in a participating Title I public school attendance area and are low
achieving
