In accordance with Ordinance 1-2019, the Borough of Topton will maintain a list of properties which, at the request of the owner or occupant, shall not be subject to door-to-door sales or solicitation. The Borough will provide a copy of the list to every person receiving a Peddling and Solicitation Permit. The list will identify only the properties and will otherwise contain no personal information regarding the property or occupants.
I hereby grant permission to the Borough of Topton to add the below address to the "Do Not Solicit List" which will be given to every person receiving a license to engage in door-to-door sales and solicitations in the Borough. It is a violation of Ordinance 1-2019 to solicit or attempt to solicit at any property identifies on the "Do Not Solicit List."
Change in residency will remove you from the Do Not Solicit List.
The First Amendment to the United States Constitution and the Pennsylvania Constitution preclude the imposition of any law or regulation which affects freedom of speech, and accordingly Ordinance 160, which addresses solicitation, does not extend to individuals engaging in political and religious speech, including door to door solicitation for such purposes. Accordingly, placement on the registry will not preclude Constitutionally protected solicitations.
