By reading these terms and submitting a request, the client enters into a legal contract with Estheticah. The information provided by the client serves as a legally binding signature, agreeing to all terms outlined in this agreement.

1. Acceptance of Terms. By purchasing the designs, you agree to these terms and conditions. If you do not agree, do not proceed with the transaction.

• No rush request. All commission requests will be processed in the order received.
  
• Minor revisions are included at no extra charge. Major changes beyond the original agreement will incur additional fees. Additionally, if the client requests revisions AFTER the cover is completed and final approval has been given, an additional fee of $10 per revision will apply.
  
• The editor reserves the right to decline any requests that are beyond their skill set.
  
• No cancellations are allowed once the concepts or sketches have been DELIVERED. The deposit will be non-refundable in such cases.
  
• An upfront payment (any amount) is required before work begins. The remaining balance is due upon completion of the artwork.
  
• Payments can be made via PayPal.
  

2. License Grant. Upon receipt of full payment, you receive a non-transferable license to use the files for personal or commercial projects as specified in the purchase agreement. The client may not alter, share, or modify the finished DESIGN without obtaining permission from Estheticah.

3. Usage Rights. Upon receipt of full payment, the client has the exclusive rights to use the design for their book and related marketing. However, you may not resell, redistribute, or sublicense the files in any form without prior written consent from Estheticah. Estheticah maintains copyright and ownership of all editable designs and draft materials. Third parties are strictly prohibited from making any modifications to the designs, including but not limited to text changes, color adjustments, or resizing. Any necessary modifications or revisions to the original design will be carried out exclusively by Estheticah or by another party with Estheticah’s written consent.
 
4. Sharing Policy. Sharing files with others is strictly prohibited unless explicitly permitted in writing by the creator. If you wish to share the files, you must buy the raw files and seek permission to follow any guidelines provided by the creator. Please be guided that buying the raw files will cost you more than the amount you paid for the 'design.'

5. Refunds and Exchanges. Due to the digital nature of files, all sales are final. No refunds or exchanges will be permitted once the files have been downloaded and transferred to the client.

6. Limitation of Liability. The client agrees to assume full responsibility for the use of the design as the client must legally own or have the rights to any images provided and assumes full responsibility for any claims or legal actions related to those images. 

Estheticah shall not be held liable for any legal issues, disputes, or claims arising from the client’s use of the design, including but not limited to copyright infringement, trademark violations, or any unauthorized use of third-party materials.

Estheticah is not liable for any similarities between its artwork and other works that arise solely from general cover trends, themes, or genres.

7. Indemnification. The client agrees to indemnify, defend, and hold harmless Estheticah from any and all claims, liabilities, losses, or damages (including legal fees) resulting from the client’s use, modification, or distribution of the design.

8. Confidentiality. All client information is strictly confidential and will only be used by Estheticah to complete the requested designs. This information is considered classified and will not be disclosed to any third party. The final design may only be included in the artist’s portfolio after the client has publicly revealed it, provided written permission to Estheticah, or if six (6) months have passed since the design was created, assuming the client does not state otherwise when contacted by the designer.

9. Proofing. The client is responsible for testing and reviewing print proofs. Design changes will be made if necessary based on the results of those proofs.

Estheticah will not be held financially or legally responsible for any issues, expenses, or losses the client may experience from using the book cover design. This includes any indirect or consequential damages such as lost income, business opportunities, reputation, or data. Estheticah is also not liable for any claims, errors, or inaccuracies found on her site or in the client’s materials, even if they result from a breach of this agreement. Clients use the designs at their own discretion and assume full responsibility for the final outcome.

10. Amendments. Estheticah reserves the right to amend these terms and conditions at any time. Any changes will be communicated to Estheticah through her social media account:
