Bathe & Racquet Club memberships are limited and will be processed on a first come, first served basis, and are contingent upon receipt of this form and payment. This agreement is entered into by and between the undersigned and the Cress Creek Commons Homeowners
Association of Naperville, Illinois (hereinafter referred to as the “Association”). The undersigned expressly acknowledges that he/she will not be afforded insurance coverage/protection by or through the Association, specifically as it may relate to personal or property damage liability, under the provisions of any insurance policy owned/or applicable to the Association. Further, the undersigned covenants not to sue and hereby agrees to indemnify and hold the Association harmless from any and all claims, losses, damages and expenses, including court costs and attorney fees, arising out of or in any way related to activities conducted within or upon Association property in the vicinity of the Association’s Bathe & Racquet Club.
