Compensatory function of sanctions and criminalization of their violation: international and Ukrainian experience. Panel discussion of the VIII Kharkiv International Legal Forum

Context:
Since the beginning of the full-scale invasion, sanctions pressure on the aggressor has become one of the main tasks of Ukraine and its partners. This has largely determined the active development of sanctions policy in different countries. In addition to the traditional role of sanctions – to change the behavior of the offender – sanctions policy is also aimed at creating sources of compensation for victims of internationally wrongful acts in connection with which sanctions are imposed.
The practice of partner countries shows how the proceeds of criminal prosecution for sanctions violations can be used for compensation.
At the same time, new legislative solutions are emerging to recover sanctioned assets, and Ukraine is highly effective in applying the sanction in the form of recovering assets of aggression supporters.
