I (As an Authorized Representative) in consideration for the privilege of participating in the Community Lighting Contest, scheduled for 12/03/2022 to 01/02/2023 (the "Event"), now agree as follows, on my own behalf and on behalf of my Group/Organization identified above and every individual associated with my Group/Organization participating in the Event (collectively, the "Releasing Parties"): I knowingly, voluntarily, and expressly waive, release, and discharge the organizers of this Event and all associated partners and sponsors, including the Rotary Club of Bangor, Maine, and its directors, officers, employees, independent contractors, volunteers, and agents (each a “Released Party”) from ANY AND ALL LIABILITY OR CLAIMS arising directly or indirectly from, or related to, my participation in the Event or any related loss, cost, injury, or expense, INCLUDING CLAIMS BASED ON THE NEGLIGENCE OF ANY RELEASED PARTY. This waiver, release, and discharge includes, but is not limited to, any claims for compensatory damages, consequential damages, reimbursement of medical or other costs, claims for lost income, and any and all other liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering and distress, or death that I, my spouse, or my children (born or unborn) may suffer in connection with my participation in the Event. I and my heirs or legal representatives forever release, waive, discharge and covenant not to sue any Released Party for any such claims. I understand that this release is intended to EXTINGUISH NEGLIGENCE LIABILITY. This release is intended to be complete, unconditional, and as broad as the law will allow. I agree to indemnify, hold harmless, and defend each Released Party from any loss, liability, or expense incurred by any Released Party arising out of (i) my participation in the Event or (ii) any breach of any representation, promise, or covenant made by me in this agreement. To the extent permitted by Maine law, I agree to pay any costs and reasonable attorney fees incurred by any Released Party in defending any claim related to my participation in the Event, including any claim made by me or on my behalf, or in any legal action with respect to this agreement. I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I VOLUNTARILY AND KNOWINGLY AGREE TO THE TERMS AND CONDITIONS STATED HEREIN, AND UNDERSTAND THAT BY SIGNING THIS AGREEMENT, I AM GIVING UP IMPORTANT LEGAL RIGHTS, INCLUDING MY RIGHT TO SUE, AS WELL AS AGREEING TO IMPORTANT LEGAL RESPONSIBILITIES. I UNDERSTAND THAT THIS AGREEMENT EXTINGUISHES LIABILITY FOR NEGLIGENCE. I represent and warrant that I have full power and authority to bind the Releasing Parties and that upon execution, this Agreement will constitute a valid and binding obligation as against the Releasing Parties and shall be enforceable in accordance with its terms. *
