I am voluntarily entering or agreeing to participate in weekly runs, as well as activities related thereto (collectively, the “Events”) hosted by Davis Square Runners, LLC (hereafter “DSR”). I agree to not participate in any Events, unless I am medically able and properly trained, and by my signature, I certify that I am medically able to perform all activities associated with the club and am in good health, and I am properly trained. I agree to abide by any decision of a event official relative to any aspect of my participation in this event, including the right of any official to deny or suspend my participation for any reason whatsoever.

I recognize that participation in the Events is a potentially hazardous activity and I willingly assume all risks associated with such participation, including, but not limited to: falls; contact with other participants; spectators, or others; vehicular or other traffic; the effects of the weather, including heat and/or humidity, wind, cold, and wet or slippery surfaces; falling tree branches or other overhead objects; and the crowded nature and other conditions of the course, all such risks being known and appreciated by me. DSR’s group activities are running related. Other activities including but not limited to biking, swimming, rock climbing/scaling, tree climbing, etc. are not condoned.

I, for myself and anyone entitled to act on my behalf, do hereby waive, release, discharge, hold harmless, and covenant not to sue (a) DSR; (b) all sponsors and officials of DSR; (c) the volunteers; and (d) all owners and lessors of premises on or in which any Events takes place, and other representatives, agents, and successors of each of the foregoing (the “Releasees”), from present and future claims and liabilities of any kind, known or unknown, arising out of my participation in the Events, even though such claim or liability may arise out of negligence or fault on the part of any of the Releasees.

In addition, I acknowledge the contagious nature of COVID-19 and other communicable diseases and voluntarily assume the risk that I may be exposed to or infected by COVID-19 and/or other communicable diseases by participating in these events. I acknowledge that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 in connection with my participation in these events and personally assume this risk.

I grant permission to DSR and the Releasees to use my photographs, motion pictures, recordings, or any other record of this event for any legitimate purposes without renumeration.

I expressly agree that this Waiver and Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Massachusetts and that this Waiver and Release shall be governed by and interpreted by the laws of the Commonwealth of Massachusetts. I agree that in the event that any clause or provision of this Waiver and Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Waiver and Release, which shall continue to remain in full force and effect.
