Waiver:
In consideration for being allowed to participate in the activities offered by BERKELEY CREATIVE COMPANY, LLC, I (PARTICIPANT) hereby agree to the following:

I am participating in the activities offered by BERKELEY CREATIVE COMPANY, LLC , which may include classes, workshops, and wellness programs (collectively referred to herein as the “Activities”), during which I will receive information and instruction about sound healing, mindfulness, meditation, energy work, and wellness.
I understand that the Activities involve sound bathing, mindfulness, meditation, and energy work. I have read and understand, that sound baths are not recommend for anyone who is pregnant, has sound induced epilepsy, heart pace maker, stent/shunt, artificial valve, cardioverter defibrillator (ICD), has Parkinson’s disease and a DBS device, suffering from severe depression/anxiety, or has metal within their body. I am fully aware of the risks and hazards involved, and I assume full responsibility for any and all risks, injuries or damages, known or unknown, which I may incur as a result of my participation.
I understand that it is my responsibility to consult a physician prior to, and regarding my participation in the Activities offered by BERKELEY CREATIVE COMPANY, LLC. I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in the Activities. I understand that it is my responsibility to update this waiver with regard to any health condition changes that I experience in the future
In further consideration for being permitted to participate in the Activities offered by BERKELEY CREATIVE COMPANY, LLC, I, and/or my heirs/legal representatives, waive, release, and forever discharge BERKELEY CREATIVE COMPANY, LLC and its officers, agents, employees, volunteers, representatives, directors and all others from any and all responsibility or liability for injuries or damages resulting from participation in the Activities, including sound healing, mindfulness, meditation, and wellness or my use of such facilities and equipment, even if such damage or injury results from a negligent act or omission.

I have read this Agreement of Release and Waiver of Liability and fully understand its contents. I am not relying on any oral, written, or visual representations or statements made by BERKELEY CREATIVE COMPANY, LLC and/or Berkeley Clements, including brochures or promotional material to induce me to participate in the Activities. I voluntarily agree to the terms and conditions stated above. I realize there are special risks that could be associated with pregnancy, prior surgeries, injuries, and medical conditions that may carry additional health concerns. I have discussed these with my personal physician, and I have obtained his or her concurrence to participate in the Activities offered by BERKELEY CREATIVE COMPANY, LLC. I fully understand that BERKELEY CREATIVE COMPANY, LLC instructors and staff are not medically trained physicians or experts in medicine, and therefore, realize that their guidance is limited to the practice of sound healing, wellness, meditation, and the techniques and routines associated with them.

This Agreement shall be governed by the laws of State of Tennessee.

Refund Policy: By digitally signing this form I agree that I am aware that there are no refunds on sound sessions/sound baths events or appointments.
