Terms of Service for Private Use

This is a contract for terms of services rendered to you: the client, by HedgeHound. By reading and signing this document you agree to these terms of service. This is a private use contract, meaning that you may not profit from the services and products provided to you from this transaction. If you would like to profit from the services or products rendered from HedgeHound you may request a Commercial Terms of Service Contract.

What to Expect from a Typical Commission Process:
Commission Initiation Signing of contract and TOS. Invoice sent. Payment received.
Approval Sketch provided to client by artist.
Production of artwork, communication by both client and artist welcome.
Completion of artwork and presentation to client.
Final Revisions (if any) made by client and completed by artist.
Final Product delivered to client without watermark.

Artist’s Rights:
The artist reserves the right to cancel a commission at anytime for any reason. The client will be offered a refund accordingly based on how much of the commission is finished. (see refund section)
The artist may refuse to take on any commission. These limits are as such and not limited to: subjects that depict pornography, subjects that are hurtful to people of race, gender, sexuality, political viewpoints, disability, etc, and subjects or characters that are owned or copyrighted by another person or entity without prior explicit permission,.

Client’s rights:
The client can alter or change the artwork so long as original credit is given to the artist and changes made are specifically listed by the client.

Ownership:
The finished artwork or product is owned by both the artist and client. The artist reserves the right to include any work in portfolios, as well as mediums of profit such as books and prints.*
The client reserves the right to repost their commissioned work on the internet, print and display for private and personal use, and typically any use that does not result in profit off of the artwork. The client cannot claim the artwork as solely theirs, or reproduce and sell the artwork in any form unless prior permission and contract has been signed.**

*The client may request a revised contract in instances where they would not like the artwork reproduced in such cases as but not limited to: character or intellectual property rights.
**If the client wishes to sell or reproduce the artwork -such as in the form of prints, books, t-shirts, etc.- a commercial terms of service and contract can be requested.


Production of Commission:
In most cases, the client will receive an initial sketch for approval of their commission and be offered revisions to their artwork.* After having received initial instructions for the artwork, the client will be provided a sketch for approval. The commission piece will be presented to the client with an “in progress, all rights reserved HedgeHound” watermark. The sketch will serve as an example of what the completed work will resemble upon completion. If the client wishes to see changes made to the artwork then this is the perfect opportunity to request such changes.
After having feedback from the client the artist will continue with the completion of the piece.** The client can request previews of the piece at any time, however the piece will be presented to the client with an “in progress, rights reserved HedgeHound” watermark at all times until completion of the artwork.
Please allow 24-48 hours for correspondence, however, less than 12 hours is the usual response time. The client may also request revisions at any point in the production process, however, this may limit the amount of revisions available to the client in the final revisions after completion.
*Some special-type commissions will not have these options. These types of commissions will be clearly stated whether or not they will have approval sketches and/or revisions and how many revisions will be allowed.
**If the client has not responded to the approval sketch then the artwork will be put on hold until communication can be made. This is to ensure that the client gets what they want to pay for, and protects the artist from putting in unwanted work. If the client does not want an approval sketch then they may request such when giving initial instructions for the commission.

Revisions
There is no limit of revision requests to the client when the client is provided the approval sketch. However, if it is deemed that the changes the client wants makes the initial sketch defunct, the artist will then provide another-different-sketch for approval. If again, the client wants a different sketch, the artist will request additional fees to cover the cost of extra work before proceeding, starting at a 20% additional fee.
After the artwork has been finished, the client will be provided the finished product. The client is allowed to make revision requests after having been provided the finished product. Artist discretion will be used to determine if the revision requests are reasonable and easy to accommodate. More often than not, the artist will complete most revision requests to ensure the client is happy with their service or product. Additional fees may apply if the client wants complex revisions to be fulfilled.
The client will be informed of additional charges to revisions before proceeding. If the revision request is something that should’ve been made during the approval sketch phase the artist will then explain and may not be able to complete the revision request. If the artist did not make a revision during the approval sketch phase the client may be entitled to a partial refund.

Refunds
A client may be entitled to a refund if the services or products provided are unsatisfactory or if the artist has not provided the services listed in this contract. Upon request the client will be provided a refund document, this document must be filled out and submitted to the artist (hedgehoundcreations@gmail.com)  in order to receive a refund.
The client is only entitled to a full refund if no progress has been made on the commission.
The client may request a partial refund at various stages of the commission process.
Partial Refunds:
After approval sketch with no further work done: 80% of total, all rights to the artwork are reserved for the artist.
During production of artwork: To be negotiated.
-Amount of the refund often depends on how close the artwork is to completion.
-The artist will offer a percentage of refund and the client will approve or deny offered refund.
After completed product: Case by case basis.

Unauthorized chargebacks made by the client will result in blacklisting and may result in small claims disputes. Please contact the artist about refunds or your unsatisfactory experience before submitting a chargeback. The artist will be more than happy to make the commissioning process satisfactory and refund money when asked.
