Nonconsensual Towing is when a vehicle is removed from a private parking lot either by the property owner's request, through a tow patrol, or generally without the owner's knowledge. Non-consensual towing is different than authorized tows, where the vehicle- owner calls the tow company to ask their vehicle be moved (ex. when a vehicle breaks down on a highway).
With many constituents, and research groups pointing to the problem of predatory towing practices in Vermont, Rep. Barbara Rachelson introduced a bill this session to implement new consumer protections to address predatory towing in Vermont.
While regulations on towing have cropped up in different states around the country, Vermont ranks as having some of the worst consumer towing protections in the country according to a recent Car and Driver report. Residents have pointed to high maximum tow costs, tows under ambiguous circumstances, and some have even lost their cars through abandoned car title transfers in the face of compounded storage fees.
With H.143, Barbara hopes to:
- pass caps on maximum fees
- protect consumers’ right to retrieve their cars with a drop-fee if the tow is incomplete
- require photos of parking offenses warranting a tow and more.
