DEFINITION: In this Release Agreement the term ‘EVOLUTION FREESTYLE Activities’ shall include but not be limited to, both on and off SITE activities, events, competitions, training, tours, activities, programs, workshops, lessons, clinics or other related services, travel or transportation related to these activities, which are organized, provided, arranged, conducted, sponsored, promoted or authorized by or in any way connected with the Releasees.

SAFETY: Myself and/or child/ward has been advised to wear an approved helmet while participating in skiing, snowboarding and other sports activities such as mountain biking, skateboarding or afternoon activities that require a helmet and to comply with all applicable municipal and provincial highway laws and regulations during camp activities. I recognize that serious head injury or death can result even when a helmet is worn.

ASSUMPTION OF RISKS: I am aware that participating in EVOLUTION FREESTYLE Activities involves many risks, dangers and hazards including the risk of serious injury and death. I UNDERSTAND AND AGREE, ON BEHALF OF MYSELF AND/OR MINOR CHILD/WARD, HIS/HER HEIRS, PERSONAL REPRESENTATIVES AND NEXT OF KIN, MYSELF, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN THAT MY EXECUTION OF THIS DOCUMENT CONSTITUTES:

AN UNQUALIFIED ASSUMPTION OF ALL RISKS associated with participation in the program by myself and/or my minor child/ward even if arising from negligence or gross negligence, including the failure by Releasees to safeguard or protect my minor child/ward from the risks, dangers and hazards associated with EVOLUTION FREESTLE Activities; including any compounding or aggravation of injuries caused by negligent rescue operations or procedures, by any one or more of the event organizer, the event venues and any persons associated therewith or participating therein; and I have satisfied myself and believe that myself and/or minor child/ward is physically, emotionally and mentally able to participate in this program, and that the equipment used by myself and/or child/ward is mechanically fit, and appropriate, for use in this program; and I understand, and will instruct my minor child/ward, that all applicable rules for participation must be followed; and that if I feel that my minor child/ward has experienced any deterioration in his/her physical, emotional or mental fitness prior to attending camp, I will remove him/her from the program.

1. TO WAIVE ANY AND ALL CLAIMS that I have or my child may have in the future against the RELEASEES AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that my child/ward may suffer or that my next of kin may suffer, as a result of my minor child’/ward’s participation in the above mentioned activities DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1996. C. 337 ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING in the above mentioned activities;

2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any property damage or personal injury to any third party resulting from myself and/or my child/ward’s participation in the above-mentioned activities;

3. This Release Agreement shall be effective and binding upon myself and my child/ward’s heirs, next of kin, executors, administrators, assigns and representatives, in the event of their death or incapacity;

4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Alberta and no other jurisdiction;

5. Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of Alberta and shall be within the exclusive jurisdiction of the Courts of the Province of Alberta. In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of participating in the above mentioned activities; other than what is set forth in this Release Agreement.
