Downtown Overlay District Survey
Enterprise City staff is in the process of making recommendations to the City Council related to the possible enactment of an ordinance which might include provisions related to a Downtown Overlay District. 

The function of a Downtown Overlay District is to establish specific uses and design standards intended to guide future development and redevelopment. The goal is to create an attractive and vibrant urban pattern that balances the pedestrian and traffic needs of residents, while it protects and enhances the original pattern of development.  Design and land development standards are intended to be flexible and encourage diversity and variation.

The Downtown Overlay District would apply to properties that fall within the below boundary marked in green:

9. The proposed ordinance may provide a provision that the basement and the first floor shall be used for business purposes only.

10. The proposed ordinance may contain a list of "approved materials" to be used during new construction, additions, and alterations to commercial and mixed-use buildings:

APPROVED MATERIAL: Exterior walls shall be finished in brick, wood, concrete formed or assembled as stone, precast concrete panels with a finish to simulate stucco texture, polished stone, and glazed brick or tile.

11. The proposed ordinance may contain a list of "prohibited materials" to be used during new construction, additions, and alterations to commercial and mixed-use buildings:

Example:

PROHIBITED MATERIAL: Vinyl siding, aluminum siding, rolled asphalt, precast concrete panels with smooth finish, fiber cement wood simulated horizontal lap siding, fiber cement panels, Exterior Insulation Finishing Systems (EIFS), T-111 plywood siding, ceramic-based coatings and sealers on the siding.

An exception request of the prohibited material list may be brought before the Board of Adjustments of the City of Enterprise to be heard.

12. The proposed ordinance may provide a provision stating no building in the Downtown Overlay District shall have degrading exterior conditions. These conditions include but are not limited to rot, peeling paint, faded paint, rust, and dirt buildup.

13. The proposed ordinance may provide a provision prohibiting off-premise storage and storage not related to the primary business in the Downtown Overlay District. Additionally, storage related to the primary business shall not be visible from the front façade of the property.

14. The proposed ordinance may provide a provision prohibiting off-premise storage but will allow property owners or tenants using these buildings for storage before the adoption of the ordinance two years of the date this ordinance is adopted to comply.

15. The proposed ordinance may prohibit the open storage of any materials or items outside in the Downtown Overlay District.

16. The ordinance may require a new permit for vacant buildings within the district which would require a fee of five hundred dollars ($500.00) to be charged. This permit may be effective for a period of up to 3 months. 

However, the ordinance may allow all of this fee to be waived if any of the below requirements are met:

-  the building is being actively marketed for sale or lease 

- the building is being rehabilitated and the owner has spent at least 5% of the assessed valuation of the building on rehabilitation

-  an owner has secured all the duly required state and local permits to demolish the building
