In consideration of the services of OYEYO LLP (doing business as the OYEYO Bouldering Gym), its owners, employees, agents, volunteers, participants, and all other persons or entities acting in any capacity on its behalf (hereinafter collectively referred to as "OYEYO"), I hereby agree to release and discharge OYEYO, on behalf of myself, my children, my parents, my heirs, my assigns, my personal representatives, and my estate as follows:

I hereby acknowledge, agree and accept that THE SPORT OF ROCK CLIMBING AND BOULDERING (BOTH INDOOR AND OUTDOOR) AND THE USE OF FACILITIES IN OYEYO, PARTICIPATION IN OYEYO ACTIVITIES AND/OR OBSERVATION OF SUCH ACTIVITIES ARE DANGEROUS AND INVOLVE RISKS.

I acknowledge that both my climbing and non-climbing related activities and use of any of OYEYO's services or facilities entails significant risks, both known and unknown, which could result in physical or emotional injury paralysis, death, or damage to myself (or to the minor on whose behalf I am signing this waiver in the case that I am signing as parent or guardian and hereafter referred to as "the minor"), to property, or to third parties.

Such risks include but are not limited to:

(a) falling off the climbing walls and (i) hitting the floor, (ii) hitting structural elements of the building, (iii) hitting obstacles or projections , (iv) hitting people, (v) hitting the climbing walls, (vi) hitting climbing holds, etc.;
(b) falling climbers
(c) loose, broken and/or falling climbing holds;
(d) equipment failures;
(e)negligence of spotters, other participants, third parties, and OYEYO.

I further acknowledge that the above list does not identify all the risks associated with rock climbing and bouldering or using OYEYO's facilities and in no way limits the extent or reach of this agreement. I understand that no amount of care, caution, instruction or expertise can eliminate the inherent dangers associated with these and other activities.

I hereby voluntarily release, waive, discharge and agree to indemnify, hold harmless and not to sue OYEYO and its owners, employees, agents, volunteers, participants, and all other persons or entities acting in any capacity on its behalf from any and all claims, demands, or causes of action of any nature whatsoever, which are in anyway connected with my participation (or that of the minor) in these activities or my (or the minor's) use of OYEYO's equipment or facilities, whether my (or the minor's) use is supervised or unsupervised, including any such claims which I, my children, my parents, my heirs, my assigns, my personal representatives, or my estate have or may have that allege ordinary negligent acts or omissions of OYEYO.

Should OYEYO or anyone acting on its behalf, be required to incur legal fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

I understand that the sport of rock climbing and bouldering is physically demanding, I declare that I am (or the minor is) medically and physically fit and free from impairment and able to participate in the activities that take place at OYEYO.

I further declare that I have (or the minor has) no physical, mental or medical conditions that should preclude e (or the minor) from participating in the activities that take place at OYEYO and that I am not participating against medical advice or treatment.

I am at least 18 years of age and otherwise legally competent to sing this agreement. This Release of Liability, Assumption of Risk, Indemnification and Participation Agreement shall be effective and binding upon me and upon my assigns, heirs, representatives, executors and administrators. My participation in activities at OYEYO or affiliated events is purely voluntary, and I elect to participate in spite of the risks.

I have carefully read, fully understand and agree to the terms and conditions of the agreement.
