PLEASE READ CAREFULLY THIS DOCUMENT AS IT AFFECTS YOUR OBLIGATIONS AND LEGAL RIGHTS, INCLUDING, BUT NOT LIMITED TO, WAIVERS OF RIGHTS, LIMITATION OF LIABILITY AND ASSUMPTION OF RISK. BY PARTICIPATING IN THE EVENT/RUN (HEREINAFTER “EVENT”) YOU ASSUME ALL RISKS AND RESPONSIBILITIES FOR YOUR PARTICIPATION, AS DETAILED BELOW.

PHOTOGRAPHY RELEASE
I hereby grant to Latinos Run/ Latinas Run/ United 2 Run and it’s sponsors/partners the unrestricted right and permission to copyright and/or use, and/or publish photographic portraits or images in still, single, multiple, moving or video format, or in which I may be included in whole or in part, or composited, or distorted in form, or reproductions thereof, in color or otherwise, (Material) in any media, advertising, or any other lawful purpose (the “images”).

I hereby waive any rights I might have to examine or approve the finished product or products or the advertising copy, social media post, printed matter or any other product in which my image is used. I waive any ownership and right to use such material except for its use as part of my personal modeling portfolio or social media.
I further release Latinos Run/ Latinas Run/ United 2 Run and it’s sponsors/partners from any and all claims for remuneration associated with the commercial or artistic use of the images. I also release them from any and all claims for damages arising from the use of the images for
commercial or artistic purposes unless it is proven that such use was produced and published for the sole purpose of subjecting me to conspicuous ridicule, scandal, reproach, scorn and indignity.

I waive any and all claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury me and/or my property might suffer in connection with the use of the images.


WAIVER OF RIGHTS
Latinos Run/ Latinas Run/ United 2 Run and it’s sponsors/partners, including all of its staff, employees and officers, shall NOT be responsible for any injury, including death, to any person participating in Latinos Run/ Latinas Run/ United 2 Run and it’s sponsors/partners events.

I hereby agree that after participating in Latinos Run/ Latinas Run/ United 2 Run and it’s sponsors/partners events I will not sue any of the mentioned parties for any and all present and future claims to which I may be entitled, including but not limited to, negligence and inherent risk connected to Latinos Run/ Latinas Run/ United 2 Run and it’s sponsors/partners events, including with no limitation, any loss, injury, damage or liability I suffered.


ASSUMPTION OF RISK
I hereby acknowledge and understand that my participation in any event entails certain risks to my health related to the unpredictability of the reactions of  the heart, lungs and blood vessels to exercise, as certain abnormal changes might occur during or after exercise, including with no limitation blood pressure anomalies and heart attacks, musculoskeletal strains, pain and/or injury.

I hereby acknowledge and understand that physical exercise might be a dangerous activity and involves the risk of serious injury, paralysis and/or death. I hereby acknowledge and agree that I participate in the event or any future group event at my own risk and assume all risks involved, whether identified herein or not, including risks and damages arising from UNITED 2 RUN’s negligence.

Latinos Run/ Latinas Run/ United 2 Run and it’s sponsors/partners WILL IN NO EVENT BE LIABLE FOR ANY DAMAGE, CONSEQUENCE, SEQUEL, SUFFERING, INJURY, ILLNESS, DISCOMFORT, DISEASE, PARALYSIS AND/OR DEATH RESULTING FROM MY PARTICIPATION IN THE EVENT.


REPRESENTATIONS & WARRANTIES
I warrant Latinos Run/ Latinas Run/ United 2 Run and it’s sponsors/partners That:
• I am in good physical condition and have no disabilities, impairments or ailments that would prevent me from safely participating in active or passive exercise. My participation in the event is not detrimental or injurious to my heart, safety and/or or physical condition.
• I have a physician's permission to participate in aerobic and/or anaerobic activities.
• My participation in the event is voluntary. I assume full responsibility for myself during my participation in the event.


COVID-19
I hereby acknowledge and agree that I am familiar with the current Centers for Disease Control and Prevention (“CDC”), World Health Organization (“WHO”), and my local government’s guidelines regarding COVID-19. I accept full responsibility for keeping up to date on the latest obligations and recommendations regarding COVID-19 prevention. I understand that my participation in the event carries a risk of COVID-19 infection. I hereby acknowledge and agree that I voluntarily choose to participate in the event despite this risk.


EXCLUSION OF LIABILITY
To the maximum extent permitted by applicable law, Latinos Run/ Latinas Run/ United 2 Run and it’s sponsors/partners shall under no circumstances be liable for any type of loss and/or damages, whether direct, indirect, incidental, special, punitive or consequential on account of any injury or accident involving and/or arising out of my participation in Latinos Run/ Latinas Run/ United 2 Run and it’s sponsors/partners Events.


BY COMPLETING THIS FORM YOU ACKNOWLEDGE THAT YOU FULLY UNDERSTAND THAT YOU HAVE VOLUNTARILY GIVEN UP SUBSTANTIAL RIGHTS FOR CURRENT/FUTURE EVENTS AND  RELEASED LATINOS RUN/ LATINAS RUN/ UNITED 2 RUN AND IT'S SPONSORS/PARTNERS OF LIABILITY AND ASSUMED ANY AND ALL RISK.
