Westpointe Master Community, Inc. Amenity Center Recreational Use Agreement

The Westpointe Master Community (the “Association”), a non-profit corporation, hereby approves the use of the “Common Areas” according to the Declaration of Covenants, Conditions and Restrictions locally known as the Fronterra at Westpointe subdivision, located at 12093 Westcreek Oaks, San Antonio, Texas 78253.

1) Use of the Community center must be scheduled at least 7 days in advance.

2) The community center is available for rental by members of the association age 18 or older and in good standing (current on assessment payments and no outstanding deed restriction violations).  This Agreement is subject to the Association's Recreational Use Rules and Regulations. It is understood that the premises are to be used 'as is' without warranty and without representations by the Association as to the suitability of the premises for the user's intended use.

3) In lieu of a security deposit made payable to the Association, the Board of Directors and/or management company reserves the right to assess a Special Assessment for any cleaning fees, damages, or other costs associated with this rental of the common area facilities as deemed necessary by the representative of the Association.

4) A user fee of $85.00 (four hour minimum) and $25.00 for each additional hour (not to exceed a total of 8 hours per reservation) which includes set-up and take-down of the event. Use of the Community center must conclude by 11:00 P.M. Sun-Thurs and 12:00 A.M. Friday and Saturday. No overnight use is allowed. The user fee shall be paid in advance and reservations are not final until this fee is received by Kith Management Services.

5) User shall use the premises in an orderly and proper manner and so as not to annoy, disturb, or be offensive to others within the recreational facilities area or immediate vicinity.

6) User shall REMOVE FROM THE PREMISE all garbage, debris, or other waste material immediately upon completion of this agreement. You are RESPONSIBLE for disposal of all trash brought on site. Use of community trash receptacles is not permitted.

7) User shall indemnify and hold harmless the Association, Kith Management Services, and their  officers, agents, directors, and employees from all claims, demands, loss, damage or expense including, but not limited to, those for death, for personal or bodily injuries, or for property damages arising out of or in connection with the use of the premises by lessee or arising out of any acts or omissions of lessee, his employees, agents, representatives, customers, guests or invitees.

8) A walk-through inspection of the facility will be completed by a representative.  A $125.00 cleaning charge will be applied to the members account if the facility is not left in a clean and orderly condition.    

9) User is prohibited from assigning or transferring this agreement.

10) User recognizes that exclusive use of the pool is not included with community center reservation. Folding tables and chairs (two 6’ rectangle tables, 30 chairs) are provided but furniture may NOT be removed from the pool area. It is the member's responsibility provide all furniture or equipment needed for their event other than what is provided in the storage room.  The clubhouse includes a refrigerator (no other appliances).

I understand that I am responsible for ensuring that my guests comply with all common area rules.  Failure to do so may result in a special assessment or revocation of pool privileges and use of common area facility.


**Residents will be responsible for costs of additional lifeguards if they are using the pool.  IF YOU WOULD LIKE TO USE THE POOL DURING YOUR RESERVATION YOU MUST REPORT THIS TO THE MANAGEMENT COMPANY AT THE TIME YOUR RESERVATION IS MADE.
