I, on my own behalf, and on behalf of my successors, heirs and assigns, [hereinafter "I"], agree that the Boston Countryside Cruisers group (B.C.C.) and the B.C.C. Organizers, co-organizers, and leadership members(hereinafter, the “RELEASED PARTIES”) shall neither be liable nor responsible for injury to me (including paralysis or death), for damage to my property, or for any injury to any riders, occurring during any B.C.C. or B.C.C. group activities and resulting from acts or omissions occurring during the performance of the duties of the “Released Parties”, even where the damage or injury is caused by negligence (except willful neglect). I understand and agree that all B.C.C. members and their guests participate voluntarily and at their own risk in all B.C.C. activities and I assume all risks of injury and damage arising out of the conduct of such activities including, but not limited to: meetings, meet-ups, rides, group activities, and trips. I release and hold the “RELEASED PARTIES” harmless from any injury or loss to my person or property which may result from my participation in B.C.C. activities and event(s). I UNDERSTAND THAT THIS MEANS THAT I AGREE NOT TO SUE THE “RELEASED PARTIES” FOR ANY INJURY OR RESULTING DAMAGE TO MYSELF OR MY PROPERTY ARISING FROM, OR IN CONNECTION WITH, THE PERFORMANCE OF THEIR B.C.C. DUTIES IN SPONSORING, PLANNING OR CONDUCTING SAID EVENT(S).I further certify and agree that I will not be under the influence of any narcotic, alcohol or other drug that may impair my understanding or judgment, and that I will not at any time during these events operate my motorcycle while under the influence of any narcotic, alcohol or any drug that may or will impair my ability to safely operate a motorcycle, peacefully attend events, or use good judgment. I also certify that I am duly licensed and competent to operate a motorcycle in a safe manner, and the vehicle is in a safe and legal operating condition. WAIVER OF RIGHTS UNDER STATE STATUTES: I further agree to waive all benefits flowing from any state statute which would negate or limit the scope of this Release and Indemnification Agreement. By signing this Release, I certify that I have read this Release and fully understand it and that I am not relying on any statements or representations made by the “RELEASED PARTIES”.I certify and acknowledge that this written Release and Waiver is the complete agreement and understanding between me and the “Released Parties” and that any practice or agreement not contained in this document is null and void unless reduced to writing and signed by the members of the Leadership Group, including a minimum of three Organizers and co-Organizers.
