Cache Count Republican Veterans Caucus - Add to the Central Committee.

Add the text to ARTICLE 1. THE COUNTY CENTRAL COMMITTEE
The Republican Party Central Committee of Cache County, Utah, hereinafter referred to as the "Central Committee," shall consist of the voting precinct...the Cache County Republican Veterans Caucus Chair, and ...

Discussion:  The Cache County Republican Veterans Caucus was formally established on February 22, 2023 in Logan, Utah with the encouragement, promotion, and cooperation of the Cache GOP executive leadership, for which it is grateful. It is a service organization, honored to be the official “Alpha Chapter” of the Utah Republican Veterans’ Caucus. Its purpose includes promoting Republican principles as embodied in the Cache Republican Party’s governing documents, advising elected officials of U.S. veteran and military issues, and encouraging the adoption of conservative practices.

Already it has grown membership to nearly 30 individuals while demonstrating its determination to benefit local Party causes. It purchased a full table at the 2023 Lincoln Day Dinner, has assisted the new officers of the Cache County Republican Women auxiliary, and has provided two speakers for the USU College Republicans veteran event this past April. As valuable contributors to our Party, veterans should be afforded the same respect and status as other auxiliaries already recognized in the same manner in our Bylaws. Please support our veterans by voting in favor of this amendment.

Eliminate Signature Gathering Advantage over Caucus-Convention Candidates

Remove the bold text:  (9G) A candidate for a county, state legislature or state school board office who filed an official intent to gather signatures and has submitted signatures but who has not been chosen by a party convention will not receive any recognition...

Discussion:  The purpose of the Cache County GOP is to enable delegates chosen by voters in a neighborhood caucus to select political candidates for primary and general election races.  The legislature passed SB54  allowing signature candidates to bypass delegates and the caucus-convention selection process, often by paying to collect signatures with outside money.   It is unfair to give signature-buying candidates the additional advantage of delegate contact lists.  The caucus-convention system allows any citizen without wealth or outside funding to run for office.

Some candidates suggest they declare as a signature candidate only to establish recognition of candidacy on the county elections web page. This grants an additional advantage over caucus-convention candidates who are not officially allowed to declare until later in the year.  The phrase that this bylaw change seeks to remove is designed to protect candidates who claim only to file for recognition.  In the days of social media, the "filing as a signature candidate for recognition only" argument is weak. 

Some candidates may claim they are dual candidates - both signature and convention candidates - as allowed by SB54.  How many signature candidates personally contacted you before the convention?  This bylaw change does not prevent a candidate from the convention ballot.

20A-9-408, 9Aii of the state code says signature candidates "submit the signatures to the election officer before 5 p.m. no later than 14 days before the day on which the qualified political party holds the party's convention to select candidates…”  If most candidates submit their signatures near the deadline, the current reading of this bylaw only prohibits the county party from providing signature gathering candidates “recognition…or assistance” during the 14 day period between submitting signatures and the convention. 

Approving this bylaw change will continue to allow signature gathering candidates to legally buy the signatures they need to bypass convention delegates without giving them the additional unfair advantage of official Party delegate contact information that should only be used by candidates who respect the delegate convention system.  Please approve this bylaw and protect the reason the Cache County GOP exists.

Voting Rules for Executive Committee Using Text or Group Chat Services, Meetings over Zoom/Teams

5A8 is a new bylaw suggestion that will allow the Executive Committee to conduct binding business electronically.  Robert’s Rules 9:30 only allows business conducted electronically IF authorized by the bylaws.  Per bylaw 2b, the chair can call an emergency meeting and if 6 attend, business can be conducted.  With the text/groupme option, all members of the committee receive information and the opportunity to vote.  

5A9 allows the Executive Committee to meet using Internet meeting software following Robert’s Rules for Electronic Meetings.

5A8 When the Executive Committee uses text or group chat services (such as GroupMe) to vote on motions outside of a noticed meeting, results are binding if all members are notified of the vote at the same time and at least 6 members vote. The balloting period starts at the time the call to vote is issued and closes when all members have voted or 6 hours has elapsed excluding the hours of 10 PM through 8 AM and all day Sunday. The party Secretary shall record minutes on electronic votes.

5A9  The Executive Committee may meet using Internet meeting services such as Zoom or Teams following Robert’s Rules Sample Rules for Electronic Meetings Scenario A (RR 12, pp. 639-641) or rules approved by the Executive Committee.  All electronic votes are roll-call votes.

Vice Chair Membership On Executive Committee 

The purpose of this change is to ensure the District Vice Chairs have a voice on the Executive Committee, while still maintaining their non-voting member status. The "5 non-voting members who may be appointed by the Chair..." has been removed because we haven't used this part of the bylaw and it keeps our EC total membership to 18, instead of 23.   This bylaw change will automatically give District Vice Chairs voting status at the County conventions according to bylaw 9B, even though they were not elected by the Central Committee.  Add the following text:

(5A2) The Executive Committee of the County Central Committee shall consist of the officers of the Central Committee, and County Council District Chairs, County Council District Vice Chairs shall be members of the Executive Committee, but shall have voting status only when the County Council District Chair is absent.

Remove the phrase:  and as many as five (5) non-voting members who may be appointed by the Chair from among appropriate party workers.

Bylaw Candidate Filing and Recognition Procedure

(11) individuals seeking to run for elected office who are not gathering signatures must file with the Party:  
  one, information listed in 7A;
  two, a signed statement declaring support for the Cache County GOP Platform with itemized exceptions, if any;
  three, if the candidate desires to use the County GOP delegate contact list, a signed ‘Candidate Use of Cache County Delegate Contact Information’ agreement approved by two-thirds of the Executive Committee before the filing period opened;  four, if the candidate desires, a signed Fair Campaign Practices pledge per Utah Code 20A-9-206.  Upon receipt of items listed above, the Party will:

1. Publish on its website and social media accounts notice of candidate filings for office with their signed platform declaration and Fair Campaign Practices pledge within 24 hours of receipt beginning no earlier than the first day of the candidate filing period for state or county elected officials; or for county party positions and special elections, no earlier than 45 days before the next convention or election. 

2. Provide to candidates who signed the ‘Candidate Use of Cache County Delegate Contact Information’ agreement, electronic delegate contact information in a CSV spreadsheet file within twenty-four hours of filing but no earlier than 30 days before the next convention or election and will provide delegate RSVP status to candidates immediately upon request at most three times after providing the delegate list.

3. Not charge any fees for filing or running or campaigning or using delegate contact lists or convention booth space, or any other reason unless required by law. 

4.  Candidates who violate the ‘Candidate Use of Cache County Delegate Contact Information’ or ‘Fair Campaign Practices’ Utah Code 20A-9-206 as determined by two-thirds of the executive committee will no longer be allowed to use delegate contact information in the current election.

This bylaw completely replaces 4D3 with new requirements:  The chair would be required to propose a budget, currently there is no requirement to have a budget, nor is any responsibility for the budget defined.  Officers may only spend money for approved items and may not spend over a budget category.  The $100 requirement requires specificity.  The last sentence will not allow officers to enter into contracts that continue beyond their term of office that financially binds future Executive Committees.  

OLD (4D3) No payments shall be made by the Treasurer for other than approved budget items without the prior approval of the Executive Committee and without the signature of two people designated by the Executive Committee.

Replace 4D3 with the following text:  (4D3) The Chair shall propose and the Executive Committee shall approve a budget for future expenses.  The Treasurer or a signer on the bank account shall only make payments by check or debit card for items approved by the Executive Committee and if budgeted, within the total category budgeted amount approved by the Executive Committee.   The budget category shall be printed in the memo line of the check.  Any budgeted expense over $100 must be a separate line item.  Credit cards may not be issued in the name of the Party.  All contracts and budgets terminate on the last day of the month following each organizing convention.

REMOVE (4D2) The Treasurer shall give the audited financial report at the Organizing Convention each year. 

Add:   The Treasurer shall provide all information requested for the financial review required in 4A2.

Discussion:  The treasurer should not give the report due to a conflict of interest.

Bylaw Auxiliaries

Bylaw 6B5 gives Auxiliary Chairs/Presidents Ex officio status to the County Nominating and Organizing Conventions.  However, the bylaws have no definition of an Auxiliary or process to recognize one.  This bylaw suggestion is modified from the state bylaws.

12) Groups may petition the Executive Committee to become or continue as an official Auxiliary every two years by meeting and maintaining the following minimum criteria: 

  1. Groups bylaws and platform are consistent with the Cache GOP Platform. and;
  2. The group has a list of at least 25 active registered Republican members and;
  3. All officers of the group are registered Republicans, and;
  4. The group’s documents shall outline a method of election of officers with terms of office not being greater than two years. 
  5. The group shall meet at least quarterly with a minimum of 10 members in attendance. Notice of all meetings shall be noticed to all members.

The Executive Committee approves or rescinds auxiliary status by majority vote.  If the Executive Committee determines that an auxiliary no longer meets any of the above criteria, it may rescind the auxiliary status of the group at any time.

Bylaw County Elected Official Special Election

Current bylaw 8H2 only allows Central Committee members to vote in special elections for candidates with an unexpired term of two years or more, whereas the CCC and County Delegates vote if less than two years.  This change allows county delegates to vote in all county wide special elections, all the more important as we will have a special election in a few weeks.  Remove the bold text:

(8H2) For vacancies in Cache County elected offices: Executive/Surveyor, Assessor, Clerk/Auditor, Treasurer, Recorder, Sheriff, and County Council; members of the Cache Central Committee and County Delegates from the precincts governed by that office shall choose a replacement in accordance with Utah Code 20A-1-508. For vacant offices with an unexpired term of two years or more, the Cache Central Committee shall select a candidate in accordance with Utah Code 20A-1-508(4),(5), and (6).

Bylaw Voting Methods

Per State GOP Bylaws, the County Nominating Convention must select a balloting method - multiple ballot rounds or preference voting.  The term “preference voting” is not defined by the State or County bylaws, an Robert's Rules is not very specific.  This change defines both methods and requires only multiple ballots at the Organizing Convention and Special Elections for races with a single winner.  Adding this language will mean we do not need to spend time in conventions and special elections debating the voting method we will use and eliminate the possibility of preference voting, ranked choice voting, approval voting at any election with a single defined winner expect at the nominating convention as required by the state bylaws.  Replace 9C with the following:

9C.  The Organizing Convention and Special Elections use multiple ballots in races with three or more candidates for one position and preference voting for races with multiple positions.  Per State Party Constitution, the Nominating Convention must choose multiple ballots or preference voting for races with three or more candidates for one position.

9C.1 MULTIPLE BALLOT METHOD: The election will have a maximum of three rounds until one candidate receives a majority vote.  If there are four or more candidates, the first round narrows the field to three, and subsequent rounds drop one candidate each time.  In the event the final two candidates tie at 50% a coin toss shall determine the winner.

9C.2 PREFERENCE VOTING METHOD: If the nominating convention chooses preference voting for a race with a single winner, the following method is used:  Voters rank candidates on the ballot in order of preference; 1,2,3 etc. with 1 being the most preferred.  Ballots are counted to establish the number of votes for each candidate. If one candidate has more than half of the first-choice votes, that candidate wins. If not, the candidate with the fewest votes is eliminated, and the voters who selected that candidate as their first choice have their votes added to the total of the candidate who was their next choice. This process continues until one candidate receives a majority of the votes, and that person is declared the winner. In the event the final two candidates tie at 50% a coin toss shall determine the winner.

Resolution Requiring Paper Ballots in Primaries and General Elections

WHEREFORE,  We, believing the above to be of such weight and persuasiveness, submit this resolution for the ratification of the Cache County Republican Central Committee to urge the Cache County Council to return us to the paper ballot voting system we had before the electronic machines to bring transparency back to our elections and which served us well for many years.
