Liability Waiver
I, ________________________________________, have volunteered to assist The Nature Conservancy, a nonprofit corporation organized and existing under the laws of the District of Columbia (“TNC”). In consideration of receiving permission from TNC and/or its affiliated organizations to participate as a volunteer, I agree as follows:
I have volunteered my time and services because of my support for TNC and my desire to participate actively in the furtherance of its work. I understand that my activities as a volunteer may entail a risk of physical injury or death and that I may be exposed to hazards arising from vehicular travel over both improved and primitive roads, unimproved topographic hazards such as cliffs, ravines, caves, loose or falling rocks, poisonous insects, reptiles or plants, use of tools and equipment and strenuous manual labor. I further understand that accidents or injuries may occur in locations or under circumstances where medical attention is not readily available.
I ACKNOWLEDGE THAT TNC MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SAFETY OF ANY VOLUNTEER ACTIVITY IN WHICH I ENGAGE, THE SAFETY OR CONDITION OF ANY REAL PROPERTY WHERE THE ACTIVITY IS LOCATED OR THE SAFETY OR CONDITION OF ANY EQUIPMENT OR MATERIALS PROVIDED BY TNC IN CONNECTION WITH THE ACTIVITY. I AGREE TO PARTICIPATE IN VOLUNTEER ACTIVITIES ENTIRELY AT MY OWN RISK AND TO ASSUME ALL ASSOCIATED LOSSES AND LIABILITIES.
I agree to abide by all rules and regulations of TNC regarding safety and use of all equipment. On behalf of myself, my estate and the personal representative thereof, my heirs and assigns, I hereby forever release TNC, its officers, directors, employees and agents, from any and all costs, claims, losses, liabilities or damages arising from or in any way related to, my service as a volunteer. I intend this release to be effective, regardless of whether the claim of liability is asserted in negligence, strict liability in tort, or other theory of recovery. For myself, my estate and the personal representative thereof, my heirs and assigns, I covenant and agree to make no claim, nor to institute any suit, action or proceeding against TNC, its officers, directors, employees and agents, relating to any accident, incident or occurrence arising out of, or in connection with, my volunteer activities.
I understand that TNC and/or its agents may take photos, videos or other recordings (altogether, "Recordings") of volunteer activities, including my participation therein. I hereby grant TNC a royalty-free, fully paid-up, worldwide, perpetual and irrevocable right to reproduce, distribute copies of, publicly perform, publicly display, publish, broadcast and exhibit in any and all languages and by and through any and all means (whether now existing or hereinafter created, including digitally and via the Internet) my voice, performance, name and/or likeness as embodied in the Recordings or any portion thereof, either alone or as part of any collective works, exhibits, programs, websites, blogs, reports, marketing materials or other publications produced by or on behalf of TNC.
If I am signing below as the parent or legal guardian of a minor child, I hereby agree to the above terms individually and on the minor child’s behalf. I further agree that I will be responsible either for personally supervising the minor child for the duration of the volunteer activities or for making arrangements for supervision of the minor by another responsible adult.
