I UNDERSTAND AND AGREE that there is potential risk for injury involved in the training and participation of any physical activity. I further understand and agree that participating in Hat Trick Ball Hockey League is a potentially dangerous activity.  Bumps, bruises, scrapes, scratches and soreness are commonplace, and most participants will encounter this sort of minor injury from time to time.   More serious injuries are possible, including sprains, strains, twists, cramps, and injuries of similar magnitude.  The possibility of more serious injury exists, including fractured bones, broken bones, torn ligaments, though most participants do not encounter such serious injuries.  There remains, despite safety precautions, the remote possibility of crippling or death.   I FREELY ACCEPT AND FULLY ACKNOWLEDGE all such risks, dangers and hazards, resulting from my participation in any event hosted or sponsored by Hat Trick Ball Hockey League.

I am also aware that I should discuss my participation in this activity with my physician to determine the effect on my current health.

It is my right and responsibility as a participant to immediately remove myself from participation in the program and notify the nearest official, if at any time I sense any unusual hazard or unsafe condition or if I feel that I am physically, emotionally, or mentally unfit for continued participation in the program.

I have read and understand the above statement of risk.  I assume responsibility for my own safety, and I understand and accept the risks involved with my participation.  

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT

I hereby agree as follows:

TO WAIVE ANY AND ALL CLAIM that I have or may in future have against Hat Trick Ball Hockey League, its coaches, officials, members, agents, directors, officers, employees, volunteers and representatives, and other participants (all of whom are hereinafter collectively referred to as “Releasees”).

I HAVE READ, understood and agree with the statements in the ACKNOWLEDGEMENT AND ASSUMPTION OF RISK portion of this document, and by assuming and acknowledging this risk, I completely absolve all RELEASEES from any and all liability for loss, damage, injury or expense that I may suffer, that a third party may suffer, or that my next of kin may suffer as a result of my participation in any of the activities and/or programs offered by the Releasees, DUE TO ANY CAUSE WHATSOEVER.  I acknowledge my responsibility to ensure adequate medical personal health, dental and accident insurance coverage, as well as protection of my personal possessions.

IN ENTERING INTO THIS AGREEMENT I am not relying upon any oral or written representations or statements made by the Releasees other than what is set forth in this agreement.

I HAVE READ AND UNDERSTOOD THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS OR ASSIGNS MAY HAVE AGAINST THE RELEASEE.

I HAVE ALSO READ AND UNDERSTOOD ALL LEAGUE RULES AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AGREE TO ABIDE THE RULES AND TO RESPECT THE CONSEQUENCES.

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may spread COVID-19, be exposed to or infected by COVID-19 by participation; and that such exposure or infection may result in personal injury, infection, illness, permanent disability, and death. I further understand that the risk of spreading COVID-19, becoming exposed to or infected by COVID-19 during participation in Hat Trick Ball Hockey activities, may result from the actions, omissions, or negligence of myself and others, including, but not limited to, the active or passive negligence (such as the failure to adequately clean and disinfect surfaces, adequately inform and educate participants re: COVID-19 protocols, adequately ventilate areas, adequately screen participants) of Hat Trick Ball Hockey League, employees or volunteers, program participants and their families.

I agree and accept responsibility to adhere to Ottawa Public Health’s (OPH) recommendations including, but not limited to staying home when showing signs and symptoms of COVID-19 (or COVID-19 like symptoms), self-isolating when required, limiting the number of people I come in contact with and practising physical distancing by maintaining two (2) metres physical distancing between myself and others and wearing a non-medical mask (ie. cloth mask) indoors and/or outdoors when keeping my distance is difficult.

I do hereby agree for myself, heirs, executors, administrators and assigns do release and forever discharge the Hat Trick Ball Hockey League or their directors, officers, employees, servants or agents (including trip/activity leaders) and all other program participants of any and all claims, demands, damages, costs, expenses, actions or causes of action whether in law or equity in respect of death, injury, infection, illness, permanent disability, loss or damage to person or property however caused, including but not limited to negligence (such as the failure to adequately clean and disinfect surfaces, adequately inform and educate participants re: COVID-19 protocols, adequately ventilate areas, adequately screen participants) arising or to arise out of my participation in such activities.
In addition, I do hereby agree to hold harmless and indemnify the Hat Trick Ball League, or their directors, officers, employees, servants or agents (including trip/activity leaders) and all other program participants from any and all claims or liability for any damage to property of, or personal injury to, any third party, due to or associated with COVID-19 or any other contagious or infectious illness, resulting from Hat Trick Ball Hockey League activities.
