I understand that by paying for the online and face to face live fitness classes, provided by Elite Aerial Arts including pole and aerial arts, strength and conditioning, HIIT and other fitness activities I hereby agree to the following: 1. I am participating in face to face and / or live streaming of fitness classes by Elite Aerial Arts during which I receive instruction via live streaming through the app, ZOOM or face to face inside Elite Aerial Arts. 2. I understand that it is my responsibility to ensure my internet connection is working before, during and after the live online class provided by Elite Aerial Arts.3. I understand that it is my responsibility to consult with my doctor prior to any online classes regarding any health conditions and existing or pre- existing injuries. I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in face to face and live online classes. In consideration of being permitted to participate in any live online fitness classes, held by Elite Aerial Arts, I agree to take full responsibility for any risks, injuries, damages, unknown or known, which might incur as a result of participating in the live online classes. I knowingly, voluntarily and expressly waive any claim I may sustain as a result of participating in face to face and live online classes. In consideration of the services that Elite Aerial Arts their agents, officers, participants, employees, and other persons acting in any capacity on their behalf, I hereby release, indemnify, and discharge Elite Aerial Arts on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:I , THE PARTICIPANT, ACKNOWLEDGE THAT MY PARTICIPATION IN LIVE FITNESS CLASSES, PERSONAL OR GROUP TRAINING AND / OR OTHER ACTIVITIES ENTAILS KNOWN AND UNANTICIPATED RISKS THAT COULD RESULT IN PHYSICAL OR EMOTIONAL INJURY, PARALYSIS, DEATH, OR DAMAGE TO MYSELF, TO PROPERTY, OR TO THIRD PARTIES. I UNDERSTAND THAT SUCH RISK SIMPLY CANNOT BE ELIMINATED WITHOUT JEOPARDIZING THE ESSENTIAL QUALITIES OF THE ACTIVITY.
