In consideration for participation in the Angel Island Fun Park's summer camp, class, and/or night-out (“Events”) at Angel Island’s facility located at either  3330 Westgate Dr, Durham, NC 27707 or 924 NE Maynard Rd, Cary NC 27513  (“Facility”), I, my assigns, minor children, and heirs (“Releasors”) agree that:

1. Releasors understand that the inherent nature of playgrounds,  running areas, jungle gyms, swings, monkey bars, scooters, slides, science experiment participation, walking offsite through an outdoor parking lot behind the Facility, using manual/hand tools, using classroom supplies, and other physical activities using play equipment (“Activities”) involves certain risks that cannot be eliminated without jeopardizing the essential qualities of the Activities and Events. Releasors further understand the nature of the risks associated with the Activities and Events.
2. The Activities expose Releasors to the usual risk of puncture wounds, cuts, bruises, and broken bones. More serious risks exist as well. These risks include, but are not limited to, the following (collectively, “Risks”): bodily injury, infection, communicable disease contraction, permanent disability, choking, paralysis, death, and other dangers associated with the Activities, interacting with others who are participating in the Activities or Events, equipment failure or malfunction, and potential misjudgment by Angel Island staff, the Releasors, or other individuals.
3. The Risks may be caused by the actions or inactions of Releasors, Angel Island’s agents, other individuals who frequent the Facility, or other individuals. There may be other risks and economic losses either not known or readily foreseeable at this time, and RELEASORS FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES that Releasors may incur because of Releasors’ participation in the Activities and Events.
4. Releasors understand and acknowledge that Angel Island Fun Park and its agents and employees are only responsible for supervising Releasors in Activities at Events during Event hours. Supervision of Releasors as they engage in Activities during any other time is the sole responsibility of the Releasors.
5. Releasors’ participation in Events is purely voluntary, and Releasors elect to participate in the Activities despite the Risks. Participation is solely at Releasors own risk and Releasors assume responsibility for any injuries or damages.
6. Releasors release, forever discharge, and covenant not to sue Angel Island regarding all liability, claims, demands, losses, causes of action, or damages which are in any way connected to Releasors’ participation in the Activities or Events or Releasors’ use of the Facility, including any claims which caused or alleged to be caused in whole or in part by negligent acts or omissions on Releasors’ account, or that of Angel Island or otherwise. Releasors further agree that if Releasors, or anyone on Releasors’ behalf, make a claim against Angel Island Fun Park despite this Release of Liability and Assumption of the Risk Agreement (“Agreement”), Releasors will indemnify, save, and hold harmless Angel Island from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such a claim.
7. Releasors agree that this Agreement is made on behalf of any minor participant and that all the releases, waivers, and promises herein are binding on that minor. Releasors further agree to defend, indemnify, and hold harmless Angel Island Fun Park from any and all claims or suits for personal injury, property damage, or otherwise which are brought by or on behalf of the minor and which are in any way connected with the minor’s participation, including injuries or damages caused by the negligence of Angel Island Fun Park.
8. Releasors have adequate insurance to cover any injury or damage that Releasors may cause or suffer while at Angel Island Fun Park, or the Releasors agree to bear the costs of such injury or damage. Releasors assume the risk of participation in the Activities and Events despite any medical or physical condition, known or unknown, that Releasors may have.
9. This Agreement contains the entire understanding between the parties with respect to the subject matter of this Agreement and supersedes all prior agreements. The laws of the State of North Carolina shall govern this Agreement and the parties’ rights. This Agreement cannot be altered or amended except pursuant to a written instrument signed by all the parties. This Agreement may be executed electronically, in one or more counterparts, and shall be deemed to be an original.

I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE. I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I ACKNOWLEDGE THAT IF ANYONE IS HURT OR PROPERTY IS DAMAGED DURING MY PARTICIPATION IN  ANGEL ISLAND’S ACTIVITIES, I MAY BE FOUND IN A COURT OF LAW TO HAVE WAIVED MY AND ANY MINOR’S RIGHT TO MAINTAIN A LAWSUIT AGAINST ANGEL ISLAND ON THE BASIS OF ANY CLAIM FROM WHICH I HAVE RELEASED THEM HEREIN. I AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
