In consideration of allowing the Participant to participate in Troop 6’s In-Person Scouting, the undersigned acknowledges and agrees that:

Assumption of Risk: I understand, acknowledge and agree that the Boy Scouts of America, Golden Gate Council, Troop 6 in Berkeley, its leaders, officers, board members, volunteers, agents, and other Participants and their parents and guardians, as well as St. John's Presbyterian Church of Berkeley, its employees, officers, and agents or volunteers, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event, shall not be liable for any injury or illness suffered by the Participant, members of the Participant’s household, or anyone else which is incident to or associated with preparing for or participating in In-Person Scouting and I voluntarily assume all risk, known and unknown, of injuries, howsoever caused, even if caused in whole or in part by the action, inaction, or negligence, of the released parties to the fullest extent allowed by law.

2. Understanding of COVID Risk: I understand that participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. I understand that COVID-19 has been declared a worldwide pandemic by the World Health Organization. I understand that COVID-19 and any mutation thereof is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. I understand that T6 does not guarantee that Participants will not become infected with COVID-19 and any mutation thereof. Further, I understand that attending In-Person Scouting could increase Participant’s risk of contracting COVID-19 and any mutation thereof. I acknowledge the contagious nature of COVID-19 and any mutation thereof and voluntarily assume the risk that my Participant may be exposed to or infected by COVID-19 and any mutation thereof by attending In-Person Scouting and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that while particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist and that T6 does not guarantee that all rules and requirements of personal discipline will be observed at all times by all Participants; and,

3. Waiver of Negligence Claims: I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my Participant’s participation; and,

4. Compliance: I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. I have reviewed the most recent directives from the Center for Disease Control (CDC), the California Department of Public Health and the City of Berkeley, the Alameda County Public Health Officers, and Boy Scouts of America regarding the risks associated with Covid-19 exposure and safe practices to follow. If, however, I observe any unusual or significant hazard during my presence or based on information provided to me, I will remove my Participant from participation and bring such to the attention of the nearest official and T6 immediately. Further, I have informed and discussed the dangers of participation and the required rules and regulations to allow participation to my Participant and they acknowledge a full understanding of them; and,

5. Release: I, for myself and on behalf of my Participant, heirs, assigns, personal and representatives HEREBY RELEASE AND HOLD HARMLESS the Boy Scouts of America, Golden Gate Council, Troop 6 Berkeley, its leaders, officers, board members, volunteers, agents, and other Participants and their parents and guardians, as well as St. John’s Presbyterian Church of Berkeley, its officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTANDING ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

6. Indemnity: I agree TO INDEMNIFY RELEASEES from all liability to anyone for any loss, damage, injury, death, or expense that may arise out of or relate to the Participant’s participation in In-Person Scouting, including while receiving advancement, instruction and/or training.

7. Waiver of Jury and Arbitration Agreement: The Participant, and the Participant's parent(s) or legal guardian(s), hereby agree to submit any dispute, claim, or controversy, arising out of or relating to (a) this agreement, (b) Participant's participation in the In-Person Scouting, and/or (3) any other interaction between the Participant and T6, including the determination of the scope or applicability of this agreement to arbitrate, to binding arbitration. For such disputes, there shall be a single arbitrator chosen by the parties. In the event that the parties are not able to agree on an arbitrator, the arbitrator shall be appointed by the United States District Court for the Northern District of California. Each party shall pay its own costs, and the parties shall share equally the costs associated with the arbitrator. The arbitration proceeding shall proceed in the City of Berkeley, and shall be governed by the Federal Rules of Evidence. The arbitrator shall provide for reasonably targeted discovery to expeditiously resolve the matter. As a threshold matter, before addressing other merits of the claim, the arbitrator shall confirm whether the waiver, release, or indemnities contained in this Agreement are enforceable under applicable law and sufficient to resolve the dispute. Judgment on the Award may be entered in any court having jurisdiction over the parties and controversy. This arbitration provision shall survive in the event that any other portion of this Agreement is held invalid. NOTICE: By signing this Agreement, you are giving up your right to commence litigation against RELEASEES in a court of law, and you are giving up your right to a trial by jury.
