Service provider agencies value each and every individual we serve. We are committed to upholding and protecting the rights of our individuals as we would any other citizen. The rights of individuals with Intellectual and Developmental Disabilities are protected under the Colorado Statute (CRS 27-10.5-112) and the agency providing services to these persons is responsible to protect these rights. Additionally, Rules and Regulations state that a person receiving services has the same legal rights and responsibilities guaranteed to all other individuals under the federal and state constitutions and federal and state laws including Section 2710.5 CRS unless the rights are modified.

𝗧𝗵𝗲 𝗿𝗶𝗴𝗵𝘁𝘀 𝘁𝗵𝗮𝘁 𝗺𝘂𝘀𝘁 𝗯𝗲 𝘂𝗽𝗵𝗲𝗹𝗱:

𝑻𝒉𝒆 𝒓𝒊𝒈𝒉𝒕 𝒕𝒐 𝒂𝒏 𝒊𝒏𝒅𝒊𝒗𝒊𝒅𝒖𝒂𝒍𝒊𝒛𝒆𝒅 𝒑𝒍𝒂𝒏: a plan jointly developed by professional persons, the person receiving services, and the person's parent/guardian if applicable, and given ample notice to attend the IDT/plan, and it is to be reviewed at least annually with any modifications added as appropriate and/or necessary.

𝑻𝒉𝒆 𝒓𝒊𝒈𝒉𝒕 𝒕𝒐 𝒎𝒆𝒅𝒊𝒄𝒂𝒍 𝒄𝒂𝒓𝒆 𝒂𝒏𝒅 𝒕𝒓𝒆𝒂𝒕𝒎𝒆𝒏𝒕: An individual has the right to be free from unnecessary or excessive medication that can be used as convenience or punishment, gain treatment for ailments and prevention of illness, not be subjected to experimental research or hazardous treatment without consent, and not to have organs removed for the purpose of transplantation without consent. (CPR Directives)

𝑻𝒉𝒆 𝒓𝒊𝒈𝒉𝒕 𝒕𝒐 𝒉𝒖𝒎𝒂𝒏𝒆 𝒄𝒂𝒓𝒆 𝒂𝒏𝒅 𝒕𝒓𝒆𝒂𝒕𝒎𝒆𝒏𝒕: any person or agency shall prohibit Mistreatment, Abuse, Neglect, and Exploitation in any form. Approved agencies will provide humane physical environments without seclusion. Individuals will have qualified staff with sufficient numbers. Physical restraint shall be employed only when absolutely necessary to protect the individual and others and a record will be kept of all physical injuries to a person as well as any incidents of MANE.

𝑻𝒉𝒆 𝒓𝒊𝒈𝒉𝒕 𝒕𝒐 𝒓𝒆𝒍𝒊𝒈𝒊𝒐𝒖𝒔 𝒃𝒆𝒍𝒊𝒆𝒇, 𝒑𝒓𝒂𝒄𝒕𝒊𝒄𝒆, 𝒂𝒏𝒅 𝒘𝒐𝒓𝒔𝒉𝒊𝒑: All individuals will have opportunities for worship that are not limited to staff convenience or preference. Individuals will not be required to perform any act contrary to religious belief, as well as not being coerced into engagement in religious activities.

𝑻𝒉𝒆 𝒓𝒊𝒈𝒉𝒕 𝒕𝒐 𝒄𝒐𝒎𝒎𝒖𝒏𝒊𝒄𝒂𝒕𝒊𝒐𝒏 𝒂𝒏𝒅 𝒗𝒊𝒔𝒊𝒕𝒔: All individuals have to right to communicate and visit with the persons of their choosing and without notice at reasonable hours, and be afforded opportunities to meet with visitors, including family, guardians, and authorized representatives, and interact in their communities. They have a right to send and receive mail. They have the right to access telephones. Policies and procedures may not prohibit the right to sexual interaction based on individual choice. Training in human sexuality and growth/development will be available.

𝑻𝒉𝒆 𝒓𝒊𝒈𝒉𝒕 𝒕𝒐 𝒇𝒂𝒊𝒓 𝒆𝒎𝒑𝒍𝒐𝒚𝒎𝒆𝒏𝒕 𝒑𝒓𝒂𝒄𝒕𝒊𝒄𝒆𝒔: No person receiving services shall be required to perform labor, but may volunteer. They shall not provide training/supervision/care to other individuals without training, supervision, and reimbursement. They may perform vocational training tasks without compensation for three months or less, anything after will need compensation. They may perform personal housekeeping tasks to improve daily living skills if set in the Service Plan. Wages can not be withheld or collected to offset the costs of providing services.

𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒗𝒐𝒕𝒆: Individuals shall be assisted with registration and voting, and training will be available to address the responsibilities of citizenship.

𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒂 𝒓𝒆𝒄𝒐𝒓𝒅: Individuals have a right to a record that is not public.

𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒑𝒆𝒓𝒔𝒐𝒏𝒂𝒍 𝒑𝒓𝒐𝒑𝒆𝒓𝒕𝒚: Individuals have the right to possess and use their own clothing and personal effects. They are presumed to be able to manage their own funds unless their Service Plan documents and justifies any limitations. Counseling and consumer education should exist to help individuals avoid exploitation.

𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒆𝒔𝒕𝒂𝒃𝒍𝒊𝒔𝒉 𝒂 𝒄𝒐𝒎𝒎𝒊𝒕𝒕𝒆𝒆 𝒕𝒐 𝒓𝒆𝒑𝒓𝒆𝒔𝒆𝒏𝒕 𝒕𝒉𝒆𝒊𝒓 𝒊𝒏𝒕𝒆𝒓𝒆𝒔𝒕 𝒂𝒏𝒅 𝒊𝒏𝒇𝒍𝒖𝒆𝒏𝒄𝒆 𝒕𝒉𝒆 𝒂𝒈𝒆𝒏𝒄𝒚: No person shall be discriminated against as a result of their attempts to self advocate within the agency, and the agency must assure access to the Board of Directors.

𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒏𝒐𝒕𝒊𝒇𝒊𝒄𝒂𝒕𝒊𝒐𝒏: Individuals have the right of notification in a language they can understand, have any rules and regulations explained to them, have their rights explained at admission and annually at their Service Plan, have the rights explained to them with having an authorized representative, and be free of discrimination (unfavorable weight because they are receiving services)

𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒈𝒊𝒗𝒆 𝒄𝒐𝒏𝒔𝒆𝒏𝒕 𝒇𝒐𝒓 𝒕𝒓𝒆𝒂𝒕𝒎𝒆𝒏𝒕:Consent means an informed consent in written form that is freely given with capacity( the ability to process the information in order to make a rational decision, at least 18 years of age, and competent), sufficient information including the risks, benefits, discomforts, and alternatives to make a decision, and voluntary (without coercion, threats, or undue influence). Consent will be given for contracts, medication treatment, admission to programs, diagnosis, evaluation and screening activities, and behavioral treatment. A person can withdraw or discontinue the consent at any time. 𝗗𝗶𝗿𝗲𝗰𝘁 𝗰𝗼𝗻𝘀𝗲𝗻𝘁 is for the person affected. 𝗜𝗻𝗱𝗶𝗿𝗲𝗰𝘁 𝗰𝗼𝗻𝘀𝗲𝗻𝘁 is from the court-appointed guardian.

𝑹𝒊𝒈𝒉𝒕 𝒕𝒐 𝒉𝒂𝒗𝒆 𝒂𝒏𝒚 𝑴𝑨𝑵𝑬 𝒊𝒏𝒗𝒆𝒔𝒕𝒊𝒈𝒂𝒕𝒆𝒅: All actual or suspected incidents of MANE shall be reported immediately to the agency.
