In consideration of Participant’s voluntary participation in the above event, Participant, on behalf of him/herself, beneficiaries, heirs and assigns covenant and acknowledge that there are serious and inherent risks involved in participation in the above event (including death or serious bodily injury) and agree to indemnify, protect, defend and save harmless Yellowstone County, Metra Park, and the NILE, their agents, representatives, employees, volunteers, sponsors, officers, directors, officials, successors and/or assigns (collectively referred to hereinafter as Operator) from and against any and all damages, losses, charges, liabilities, obligations, penalties, claims, litigation, demands, defenses, judgments, suits, actions, proceedings, costs, disbursements, and/or expenses, including, without limitation, all reasonable attorneys' fees, which may now or in the future be undertaken, suffered, paid, awarded, assessed, imposed, asserted or otherwise incurred by Operator relating to, resulting from or arising out of Participant’s use of Yellowstone County’s Metra Park facilities and/or due to participation in the above event, including but not limited to any death, loss or liability to Participant’s person or property, or to that of any other person or property. Further, Participant does hereby consent to and authorize Operator to use any photographs and/or video which may be taken of Participant during the Radiant Rodeo event for future promotional purposes.
