All actively enrolled students at Breathe Dance Company acknowledge and accept the following before participating in any class, trial, workshop, performance or event organised by Breathe Dance Company:

ACKNOWLEDGMENT OF RISK AND HOLD HARMLESS AGREEMENT

I hereby acknowledge that I have voluntarily chosen to enrol and participate in the classes (including trials and workshops), practice sessions, performances and/or events, and use equipment owned by and in the studios of Breathe Dance Company Pte Ltd for pole fitness, dance and stretch (herein after collectively called “program”) provided by Breathe Dance Company.

I understand the risks involved in the program. I recognise that the program and its activities involve the risk of injury, and I agree to accept any and all risks associated with it, including but not limited to property damage or loss, minor bodily injury, severe bodily injury, and death.

Furthermore, I recognise that participation in the program involves activities and risk including but not limited to damage or injury from slip or fall, dislocated joints and/or other bodily injury. I am voluntarily participating in the program and its activities with the knowledge of the risks involved and hereby agree to accept any and all inherent risks of property damage, bodily injury, or death.

I understand and acknowledge that I should consult a physician prior to participating in the program. I also acknowledge that I am completely responsible for obtaining adequate medical or dental insurance to cover bodily injury, illness or death that may occur while or from participating in the program. I also acknowledge that I am completely responsible for obtaining insurance for personal property damage or loss that may occur while or from participating in the program.

I agree to become familiar with the rules and regulations of the program. I agree not to violate said rules or instruction made by the person or persons in charge of said program. I voluntarily agree to assume the complete risk of any activity done in violation of any rule or directive or instruction.

In consideration of my participation in the program and the fullest extent permitted by law, I agree to indemnify, defend and hold harmless Breathe Dance Company Pte Ltd from and against all claims arising out of or resulting from my participation in the program. “Claim” as used in this agreement means any financial loss, claim, suit, action, damage or expense, including but not limited to attorney’s fees, attributable to bodily injury, sickness, disease or death or injury to or destruction of tangible property including loss of use resulting therefrom. In addition, I hereby voluntarily hold harmless Breathe Dance Company Pte Ltd from any and all claims, both present and future, that may be made by me, my family, state, heirs or assigns.

I hereby expressly agree to indemnify, defend, and hold harmless Breathe Dance Company Pte Ltd for any claim arising out of or incident to my participation in the program, unless claim is caused by wilful misconduct of Breathe Dance Company Pte Ltd.

I also understand that use of equipment furnished in the program constitutes an acceptance of said equipment on an “AS IS” basis. Further, I agree to indemnify, defend, and hold harmless Breathe Dance Company Pte Ltd for any claim arising out of or incident to my use of said equipment in the program.

I further understand that this assumption of risk and hold harmless agreement is intended and interpreted to be enforced under the laws of the Republic of Singapore. I further understand that if any portion hereof is declared to be invalid for any reason, it will not affect the validity of any other portion and the remaining portions shall continue in full legal force and affect.

I agree that this acknowledgment of risk and hold harmless agreement is effective for as long as I participate in the program.
