I (or Legal
Guardian) hereby acknowledge and agree that, in consideration of my
participation in skating programs, activities, whether occurring in the near or
distant future, organized, operated, or permitted by Mansi Skating Inc.:
1. To indemnify and hold harmless releasees from all damages or
losses because of any claim, demand, cause of action including those involving
negligence that may be made or initiated by, or on behalf of my/our child, arising
out of my/our child’s Participation.
2. Skating exposes participants to many risks and hazards (“Risks
and Hazards”), some which are foreseeable, some of which are not.
3. Because of Risks and Hazards, I/we or my/our child as a
participant may suffer serious personal injury, even death, as well as property
loss.
4. I freely and voluntarily assume all Risks and Hazards, and that
my or my/our child’s Participation is entirely at my/our own risk.
5. To undertake to skate safely and always wear protective
equipment (minimally helmet and wrist guards); no Releasee assumes any responsibility
for my safety or the safety of my/our child during Participation.
6. I have read this document, fully understand it, and am/are
voluntarily signing it.
7. Will be forever prevented from suing or otherwise claiming
against any Releasee for any loss or damage connected with any property loss or
personal injury I/we sustain during Participation.
8. have been given the opportunity and encouragement to seek
independent legal advice prior to signing this document.
9. Mansi Skatin Inc. would not permit Participation by me or my/our
child unless I signed this document, which need to be brought to attention before
participation.
10. This document is binding on myself, my heirs, my executors,
administrators, personal representatives, and assigns.
11. The use of alcohol and/or drugs prior to or during participation
in any skating program or activity is strictly prohibited.
12. To follow all instructions and rules provided by Mansi Skating
Inc., including those related to skating techniques, equipment use, and
facility access.
13. Mansi Skating Inc. reserves the right to suspend or revoke my or
my child's participation in skating programs or activities for any violation of
the terms and conditions or any other reason deemed appropriate by Mansi
Skating Inc.
14. To promptly report any accidents, injuries, or property damage
that occur during my or my child's participation in skating programs or
activities to Mansi Skating Inc.
15. Mansi Skating Inc. may modify or cancel skating programs or
activities at any time for any reason.
16. Any disputes arising out of my or my child's participation in
skating programs or activities will be resolved through binding arbitration in
accordance with the laws of the state where the program or activity takes place.
17. To waive my right to a trial by jury and to participate in any
class action or collective action lawsuit against Mansi Skating Inc.
18. This agreement constitutes the entire understanding between me
and Mansi Skating Inc. regarding my or my child's participation in skating
programs or activities and supersedes all prior agreements and understandings.
19.I hereby authorize
the use of any image, photograph or videotape of me (or my child) within the framework
of the activities of the courses
