「서울대학교 인권헌장」 제정에 대한 의견서


1. 「서울대학교 인권헌장」의 제정을 지지합니다.

2. 「인권헌장」은 모든 구성원의 동등한 존엄을 확인하고 구성원의 인권과 인권 책무에 관한 기본 규범을 제시합니다. 「인권헌장」 제정 과정에서, 규범의 목적과 취지를 거스르지 않는 선에서 일부 조문의 기술적 수정은 있을 수 있습니다. 하지만 모든 인간의 도덕적 평등이라는 본질적 내용을 담고 있는 차별금지·평등권 조항이 훼손되어서는 안 됩니다. 차별금지·평등권 조항은 역사적·정치적으로 차별당해온 집단을 구체적으로 열거함으로써 이들에 대한 차별의 역사를 반복하지 않겠다는 의지를 표현하기도 합니다. 현 「인권헌장」(안)에 명시된 차별금지 사유 목록은 이러한 취약 집단에 대한 국제 인식의 현황을 반영한 것으로, 이 가운데 어느 하나를 생략한다는 것은 보편적 인권 보호 목적의 관점에서 극히 우려스러운, 눈에 띄는 누락(conspicuous omission)이 될 수밖에 없습니다. 현 「인권헌장」(안)은 표현의 자유를 명시적으로 보장하고 있으며, 차별금지·평등권 조항으로 인하여 표현의 자유에 대한 침해가 허용되는 것이 아닙니다. 오히려 차별금지·평등권 조항의 취지에는 모두의 표현의 자유가 실질적으로 보장되는 토대를 마련하는 것도 있습니다. 실제 상황에서 특정 권리가 침해되었는지, 또는 정당한 사유에 의한 권리 제한인지에 대한 판단은 인권헌장 자체가 사전에 결정하는 것이 아니라, 개별 사안에 대한 구체적 숙의와 발전적 해석과정을 통해 이루어져야 하며, 이는 「인권헌장」 제정 이후 우리 모두의 과제라고 할 것입니다.

3. 「인권헌장」의 제정은 서울대학교가 인권 존중과 보호에서 선도적 역할을 하면서, 한국 사회와 국제 학계에서의 사회적 책무를 이행하는 데 디딤돌이 될 것입니다. 「인권헌장」의 제정과 실효성 있는 규범화를 촉구합니다.


Statement on the Adoption of the Seoul National University Human Rights Charter.

1. We, the undersigned, support the adoption of the Seoul National University Human Rights Charter.

2. The Human Rights Charter affirms the equal dignity of all university members and provides basic norms on their human rights and human rights responsibilities. In the course of the enactment of the Charter, technical amendments to some provisions, consistent with the object and purpose of the relevant provisions, may be appropriate. However, the non-discrimination and equality article, which articulates essential content affirming the moral equality of all human beings, must not be altered. By specifically listing groups and traits that have historically and politically been targeted with discrimination, the non-discrimination and equality article expresses a commitment not to repeat this history of discrimination. The list in the current Charter draft reflects current international awareness of such vulnerable groups. Omitting any one of them would amount to a deeply troubling and conspicuous omission from the perspective of universal human rights. The current Charter draft explicitly guarantees freedom of expression and the inclusion of the non-discrimination and equality article does not ipso facto infringe upon freedom of expression. Indeed, the purpose of the non-discrimination and equality article includes laying foundations for the effective enjoyment of freedom of expression by all. Judgment about whether specific instances of behavior or expression violate others’ rights, or whether such behavior or expression may therefore justifiably be limited, will have to result from deliberation and interpretation specific to the case. The Charter does not predetermine judgments of this sort.  Rather, this will have to be the work of all of us as members of this institution.

3. Adopting the Human Rights Charter would serve as a stepping stone to Seoul National University becoming a leader in human rights respect and protection, in both Korean society and international academia. We urge the adoption and effective institutionalization of the Charter.
