Despite its numerous advantages such as cost and time saving, preservation of commercial relationships and flexibility of the proceeding, mediation is still not the first choice when it comes the time to choose how to settle a dispute. A multi-tier dispute resolution clause that includes mediation as a compulsory stage before accessing arbitration could be a solution to strengthen the use of mediation.
In this session, the panel will discuss the use of multi-tier dispute resolution clauses, their pros and cons and if increasing the use of this type of clause instead of a more traditional arbitration clause would be beneficial for the use of mediation.
