WAIVER OF LEGAL ACTIONS AND RELEASE OF LIABILITY FOR USE OF TREECASA HOTEL & RESORT'S FACILITIES AND SERVICES.

NOTICE: This statement contains an exemption from al responsibility, likewise, by means of this exemption from responsibility, the signer waives any kind of civil and criminal actions, causes of action, lawsuits, claims or claims for compensation for damages. The signing of this disclaimer produces legal consequences. Please read this disclaimer comprehensively before signing.

I hereby declare that I acknowledge that participating in activities such as, but not limited to, those listed below carries the risk of participants suffering physical injury including death, or damage to their property. The risk and eventual consequences of occurring, will be the result of carelessness, inexperience, physical condition, health, use of alcohol, pathologies, use of medications or other conditions attributable to the participant and not to the facilities. Since I recognize that said facilities are optimal, but require proper use by participants:

Pool Use:

I have been warned that there si not an exclusive lifeguard on duty for me nor my companions. Therefore, I am responsible for the safe and proper use of the pool during my stay and that of my companions.
My use of the pool facilities during my stay involves certain risks, including, but not limited to:

1. The risk of injury resulting from tripping or falling ni the pool area, using the slide or jumping from the dive areas.
2. The risk of injury resulting from the collision of unsupervised divers and swimmers.
3. The risk of death or other major injury resulting from participating ni any action ni the pool.
4. The risk of physical conditions or health issues brought on by alcoholic consumption, drowsiness due to the use of medicines or others.
5. The risk of death or other major injury resulting from diving head first in the pool.
6. The risk of death or other major injury resulting from diving head first or jumping outside of the 3 meter deep zone of the pool.

I assume responsibility for any damage or harm that minors under my guardianship who participate in activities at TreeCasa Hotel & Resort may suffer. Consequently, I hereby absolve and irrevocably release Paradise Timber Wood SA, its directors, shareholders, representatives, administrators and workers from al liability for any injury, damage or loss of property that may result from participation ni activities at any of the TreeCasa Hotel & Resort facilities.

I declare and accept on my own behalf and on behalf of the people under my guardianship, that the risks of using the equipment and participating in activities at any of the physical facilities of TreeCasa Hotel & Resort, is not the responsibility of the exonerated. Therefore Iwaive and oblige myself ot kep them safe or free from any kind of legal action, such as civil action, lawsuits, claims or claims of compensation for damages, or ni any other way, whether direct or indirect, that I or any other person, company, or other entit could have or claim to have and that arise from or as a result of my use of the facilities, equipment ro participation in the activitie carried out ni any of the physical facilities of TreeCasa Hotel & Resort. I release Paradise Timber Wood SA, its directors, shareholder: representatives, administrators and workers from any liability for injuries suffered by minors under my guardianship and for the damage or loss of property that occurs from or ni relation to my use of facilities, equipment or participation ni activities.

This exemption also includes health effects caused by the consumption of food and beverages associated with het consumption medications, allergies and/or medical prohibitions suffered by the undersigned and the people whom I represent by reason of age and capacity. Ignorance of allergies does not invalidate this exemption.

I release from al responsibility for any loss, damage, injury, expense or other cost that I or my family members may suffer, companion or representatives may suffer, ni relation to my use of the TreeCasa Hotel & Resort facilities.This includes the parking area and all proper registered ni the name of Paradise TimberWood .S A.

I exonerate Paradise Timber Wood SA, its subsidiaries and affiliates, its directors, shareholders, representatives, administrators a workers from al responsibility of acts classified by law as crimes or quasi-crimes that by action or omission could be executed by undersigned and/or by those persons to whom by reason of age and/or disability I represent.

I have read and I am aware of this document and I grant permission to TreeCasa Hotel & Resort Nicaragua and its agents and employees the right to send me email and phone messages, for marketing purpose (promotion, advertising) in any manner or in any medium. I hereby release TreeCasa Hotel & Resort Nicaragua and its legal representatives for all claims and liability relating to said messages and emails. TreeCasa Hotel & Resort Nicaragua remain available to any email request to remove from our email and message listing any clients email and or phone and also any request of unsubscribe through email or phone messages call to action.

I the undersigned, on my own behalf and on behalf of the minors under my guardianship, declare that I am over 18 years of age and that I am responsible for and will abide by al property rules; and that all minors listed and identified here under my charge are my responsibility and I will continuously monitor their safety. The representation that I attribute to myself of the minors and/or incapacitated has binding effect infavor of the exonerated even when said representation is not based on parental authority since it si assumed that the parents of the minors and legal representatives of the incapacitated have trusted me person taking care
of them.

Although we offer a safe and welcoming environment, the hotel does not assume responsibility for any incident or accident that may arise when driving your vehicle, automobile, motorcycle or bicycle when going up or down to the hotel, through any of our two entrances.

Having read this disclaimer, I understand the value and legal implications of the disclaimers and statements contained ni this disclaimer. In my name and/or that of my dependent(s) I renounce the exercise of the actions referred to here. I declare that I sign freely and without any type of coercion or force, incentive or guarantee of any nature and with the intention that it si a complete and unconditional waiver of al responsibility in accordance with what is allowed by applicable laws. In the event that a competent court considers that any provision of this release si invalid, inoperative or unenforceable, such consideration will not affect any other provision contained ni this release of liability, nor will it render such provisions invalid, inoperative or unenforceable. I make such resignation in full application of the autonomy of the will of the parties.

I declare that this Waiver, Release and Agreement is fully effective and will be effective and binding on me, my heirs, closest relatives, executors, administrators and assignees, or any other person authorized to act on my behalf or on behalf of my estate. I have read and understood this document. I am aware that, by signing this document, I waive certain legal rights that I may have against those released and I fully agree to do so.

For the purposes of this exemption from all liability, I declare that the following people are under my guardianship and I authorize them to use theTreeCasa Hotel & Resort facilities.
