In consideration for being permitted to use the rope swing located at the Somerset Lake and
Game Club, the above-named participant (the “Participant”) and/or their undersigned legal
guardian (if the Participant is a minor) (the “Legal Guardian”) hereby acknowledge and agree to
the terms and conditions set forth in this rope swing waiver form (this “Waiver”):
Assumption of Risks: The Participant and/or the Legal Guardian (hereinafter “I”) is/are aware
that using a rope swing involves certain inherent risks, including but not limited to, the risk of
falling, injury from impacts, collisions with objects or other participants, and the risk of injury or
death. I voluntarily assume all such risks and agree to use the rope swing at my own risk.
Release of Liability: I hereby release, discharge, and hold harmless the owner(s) of the property
where the rope swing is located; Somerset Lake and Game Club; and their affiliates,
employees, agents, and representatives (collectively referred to as the "Releasees"), from any
and all claims, demands, actions, causes of action, losses, liabilities, damages, costs, and
expenses, whether known or unknown, arising out of or in connection with my use of the rope
swing, including but not limited to personal injury, property damage, and/or wrongful death.
Waiver of Claims: I hereby waive any and all claims I may have now or in the future against the
Releasees arising out of or in connection with my use of the rope swing. This Waiver includes
claims resulting from the negligence, gross negligence, or willful misconduct of the Releasees.
Indemnification: I agree to indemnify, defend, and hold harmless the Releasees from and
against any and all claims, demands, actions, causes of action, losses, liabilities, damages,
costs, and expenses, including reasonable attorney's fees, arising out of or in connection with
the use of the rope swing by the Participant.
Medical Attention: I authorize the Releasees to obtain medical attention for the Participant in the
event of an injury or illness while using the rope swing if they deem it necessary. I understand
that I am responsible for any costs associated with such medical attention.
Acknowledgment of Rules: The Participant has read, understands, and agrees to comply at all
times with the Rope Swing Protocol, which includes rules and instructions for the use of the
rope swing. If the Participant is a minor, then the Legal Guardian has read, understands, and
agrees to comply at all times with the Rope Swing Protocol, has explained the rules and
instructions for the use of the rope swing to the Participant, and represents that the Participant
understands and agrees to comply at all times with those rules and instructions. The Rope
Swing Protocol is annexed to and is a part of this Waiver.
Governing Law and Jurisdiction: This Waiver shall be governed by and construed in accordance
with the laws of the State of New Jersey. Any legal action or proceeding arising out of or in
connection with this waiver shall be brought in the Superior Court of New Jersey in Somerset
County, New Jersey.
By signing below, I acknowledge that I have read this waiver, understand its contents, and
agree to be bound by its terms and conditions.
*The undersigned hereby certifies that I am the legal guardian of the Participant if participant is a minor.
