COOTA 400 Waiver for all Competitors and Attendees 2023
Please Read below as all drivers must agree if they wish to attend.
You will need to sign a waver on the day as well.
1. INDIVIDUALS AND INDIVIDUAL VEHICLES ARE ENTERING AT THEIR OWN RISK.
We are not liable for any damage caused to your vehicle, property or personal injury as a result of entering the event.
2. No insurance company insures vehicles being used in racing or trialing. All injuries to participants caused by operational fault of their vehicle is NOT covered by insurance. We strongly recommend that you undertake a mechanical inspection of your car prior to racing, as well as ensuring you yourself are fit to race.
3. By reading and signing this waiver you are ACKNOWLEDGING and understand that you are entering at your own risk. That the organizers hereon shall not be liable in respect of Personal Injury of competing drivers or damage to property (including loss of use of property) of competing drivers in a race, practice, competition, or trial caused by or arising out of active participation as a competitor in that race, practice, competition or trial and that injuries may be compounded or increased by rescue operations or procedures of the releasees.
4. The participant ,hereby assumes full responsibility for the preparation and safety of the vehicle to be driven and further gives an assurance that the vehicle is legally registered, has been checked and is in a condition fit to be used for motor racing. All owners should negotiate or ask for any coverage with their own insurance providers.
5. Understand that the Airport is an operational Airport and has uneven ground, objects that could cause people to trip over and could cause injury. I acknowledge that I am responsible for my own safety around the venue and will look out for hazards, such as a moving Cars, Aircraft, Fuel station and other structures & obstacles.
6. Hereby agrees that this Release and Waiver of Liability of Risk and Indemnity Agreement extends to all Acts of negligence by the Release, INCLUDING NEGLIGENT RESCUE OPERATIONS, and is intended to be as broad and inclusive as is permitted by the laws of States / Territory in which the Event is, notwithstanding, continue in full legal force & effect.
7. Hereby understand that COOTA 400 and activities are insured & run as a PRIVATE event. All MUST follow instructions from all event Staff.
8. The Event Manager and Marshalls reserves the right to refuse entry and eject any person from the event at his discretion.
9. Hereby understand that by entering the venue COOTAMUNDRA AIRPORT you will be filmed and photographed by our film crew, staff, event partners and sponsors and give consent for photos and videos to be used by SMC and Sponsors as they see fit in various features and publications including, but not limited to COOTA400 Facebook page, magazines, You Tube and Television stations along with other Social Media outlets. Also understand that as a Private event, Drivers, Crew and Guests may film the event on their phones from viewing area & pits ONLY.
10. MOTORSPORT IS A DANGEROUS SPORT and YOU ARE ENTERING AT YOUR RISK. NO CHILDREN UNDER THE AGE OF 16 WILL BE PERMITTED WITHIN THE AIRPORT GROUNDS. PLEASE ACKNOWLEDGE WHAT YOU HAVE JUST READ.
11. I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT.
12. I FULLY UNDERSTAND ITS TERMS.
13. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT OR PREJUDICE, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
