Please Read Carefully Before Signing- Release and Waiver of Liability, Assumption of Risk, Indemnity, and Participant Consent Agreement (“Release Agreement”).In consideration of the acceptance of my application for participation in the International Men’s Day basketball tournament events (the “Event”) hosted/instructed/coached by the Family Resource Centre (FRC), I hereby release and discharge FRC, its staff members, officers, directors, coaches, sponsors, Cayman Shores Development Ltd. (“CSDL”) together with CSDL’s affiliate companies and the Cayman Islands Government (the “Released Parties”) from any and all claims, responsibilities, damages, or liabilities for injuries or harm incurred as a result of my participation/volunteering or as a player in programs and activities or as a spectator in connection with the Event.I agree to hold harmless and indemnify the Released Parties from and against any and all claims, whether direct or indirect, third party claims, actions, costs, expenses and demands in respect of death, injury, damage, loss or expense suffered by any party resulting from my participation in this Event, including whether due to any negligent acts, omissions, and/or carelessness of the Released Parties, as defined herein.I understand that some sports involve physical contact between players, which occasionally serious accidents may occur causing serious personal injuries during such activities. I understand that I will be participating in the Event at my own risk and that I am responsible for the risk of participation in the Event “including the risks related to COVID-19 as outlined below. Nevertheless, knowing the risks of participation, I here-by agree that I assume those risks. I further authorize medical treatment for myself at my sole cost, if the need arises.The novel coronavirus (“COVID-19”) has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact, contact with contaminated surfaces and/or objects and, even possibly, by air. As a result, the Cayman Islands Government has recommended social distancing and has, in certain locations, restricted or prohibited the congregation of groups of people. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. The Released Parties cannot prevent you or your children from becoming exposed to, contracting or spreading COVID-19 whilst participating in the Event or entering premises. I have read and understood the above warning concerning COVID-19. Participating in the Event is of such value to me and/or my children that I accept the risk of being exposed to, contracting and/or spreading COVID-19 in order to participate in the Event and enter premises in. The Event will be governed by such limits for public gatherings as imposed by the Cayman Islands’ Government’s restrictions and limitations pursuant to the relevant COVID-19 regulations and, as such, the Released Parties may have to limit or restrict participation in the Event or terminate the Event on short or no notice in order to comply with any laws or regulations imposed by the Cayman Islands Government. Without prejudice to the other terms of the this Release Agreement, I hereby forever release and waive my right to bring suit against the Released Parties in connection with the exposure, infection and/or spread of COVID-19 related to participating in the Event or entering premises.I also understand that I may be required to leave the premises should I exhibit undesirable conduct.
