RETAINER FEE - In order to reserve  your date, your non-refundable retainer must be submitted. Your session will not be added to the calendar until the retainer is received. Your requested date will not be held until your session retainer is submitted. The retainer will be deducted from your overall session fee. *

SESSION DATE/TIME/LOCATION - This should have already been discussed with the photographer, however, if you do not know what your day/time/location is, please contact April Corey at Smile@PersimmonLanePhoto.com or 443.975-8197 (text ok). You must submit your retainer immediately to secure your requested date! *
RETAINER - Retainer must be paid in order for Photographer to officially schedule the day and time discussed. Failure to submit the retainer within 7 calendar days will result in the release of your requested date, and may be booked by others. The retainer feee for a photographer session, (excluding weddings) is $50 and will be applied to the balance of your session. This can be paid via paypal using http://paypal.me/PersimmonLanePhoto, Venmo: https://venmo.com/persimmonlanephoto or by mailing a check made out to Persimmon Lane Photography. You may also drop off cash IN PERSON at: 7110 Persimmon Lane, Owings, Md 20736. Any checks that are returned for insufficient fees will be additionally applied to your session balance. *

FINAL PAYMENT - Clients are aware of the balance of their session (which is the session fee, minus the retainer you've paid) is due the day of your session. Clients may pay with PayPal https://paypal.me/persimmonlanephoto, Venmo: https://venmo.com/persimmonlanephoto Cash, or check. Please bring the remaining balance of your session with you. Failure to submit payment will delay the completion schedule of your images. Images will not be edited until payment is made. Once payment is made, the 2-week turn-around time will be applicable. *

LATE ARRIVALS - Photographers may have other sessions scheduled after clients, so arriving late may drastically compromise the outcome of photographs due to having to rush, -or- may cause the session to be cancelled. Client is aware and agrees that they will not receive a refund or credit for further session if late. If clients are running late, they agree to contact the photographer as soon as possible. Clients acknowledge that the Photographer may not be available to take their phone call as the Photographer may be working with other clients. *

COOPERATION OF CLIENTS - Clients agree to cooperate during the session in the following ways: a) Clients or onlookers attending the session agree not to take photographs during the session, including cell phone shots. Photographer reserves the right to end the session immediately if any outside photography is taking place. b) Clients agree to not force children to cooperate. If children do not cooperate, just relax! Photographer will do their best to ignore the behavior and distract them by moving on and not making a big deal of it. Remember, I'm new to them and they are in a strange new place so it's a lot to process! c) Location: if shooting in a location that's geographically challenging, it is the client's responsibility to convey they are uncomfortable. Location will be agreed upon; we will never force you in a pose you are unsafe in or risky. Client holds photographer harmless of accidents or injuries that could happen during a session. d) Client understands that the photographer cannot guarantee the outcome of images due to poor facial expressions due to lack of participation of clients being photographed. Photographer will do everything they can to help ensure a pleasing experience but is ultimately limited by cooperation of clients. This especially applies to children, but may also include adults who are unenthusiastic! *

PERSONAL SCENTS - Please avoid wearing perfumes and heavy scents during our session. Most of our sessions are either outdoors which can attract bugs or in a small space which can sometimes make them seem stronger and unpleasant. *

TURN-AROUND-TIME - Photographer's standard turn-around time for delivery of digital goods is 2 weeks. Clients should not expect images any sooner than the 2 week mark. If circumstances arise in which photographs will not be available within the standard timeline, photographer will communicate to clients. Images are considered to be the artwork of the Photographer. Each image is adjusted by hand and is not edited by applying "one size fits all" filters to your images. Persimmon Lane strives for consistency within your images and ask that you be patient with your gallery to ensure quality and consistency. Sneak peeks are not part of our standard service and if any sneak peeks are posted they are to be considered a bonus. Generally the artist will not release images as they are edited together. *

RUSH FEES - We know sometimes life happens and you need your photos faster than our standard turn-around time. Clients may opt to rush their photos for an additional fee of $50 for 2 business days, or $100 for next day service. EDITING AND RETOUCHING - Photographer will perform limited color correction to your delivered images. Basic color correction includes white balance, contrast. Any extensive editing will be done at the Photographer's discretion. Edits requested beyond basic included editing shall be incurred at the cost of the client. The rate shall be no less than $10 per image, but subject to current rates for professional retouching services (sourced). Photographer uses professional software (Adobe Lightroom and Photoshop) and may consult with other professionals to process images at his or her discretion. *

PHOTOGRAPHER'S STYLE - Any client wishing for photos to appear differently than the style that is being offered should contact the photographer immediately. Photos will not be re-edited to an alternate style. By booking clients understand images will be similar in outcome to those posted on the Photographer's website and social media. *

12. COOPERATION OF CLIENT AND GUESTS - The Client agrees to cooperate with the Photographer and defer to the Photographer’s professional judgment related to setting, poses, picture grouping, and other matters of artistic discretion. The Photographer retains the absolute right to refuse to photograph any situation, pose, or grouping that would interfere with the Photographer’s artistic discretion, as well as any photographs that compromise safety. The Client will utilize best efforts to ensure that guests and attendees cooperate with the Photographer. *

IMAGE DELIVERY - All images will be delivered digitally. Client will not receive prints unless they are purchased separately. Digital images come with a standard print release which can be found here: https://www.persimmonlanephoto.com/contracts *

GALLERY DELIVERY - All digital images will be hosted to a gallery. You will be emailed a link to download your images, along with a coupon code for the number of images you purchased. To select your images, please add them to the cart and then use the provided coupon code to "zero" out your "purchase" (download). Additional images, as well as professional quality prints can be purchased. We encourage you to share your images by posting your favorites to your page once you download them. *

STORING YOUR IMAGES - Clients acknowledge the photographer does not maintain an archive of images. Once your images are delivered, you will need to create multiple back-ups to ensure that your images aren't lost or damaged. Photographer makes no promises to re-deliver images once they are downloaded and reserves the right to impose an archive fee of $25 if the gallery needs to be reposted. Photographer receives an email confirmation once your images are downloaded and complete. Please download your images within 14 days of delivery. It is the responsibility of the client to let the Photographer know if there are issues during the download process. Photographer not responsible for clients who do not download images due to claims of ignorance or forgetfulness. *

PRINT RELEASE VS. COPY RELEASE - A print release will be issued to clients which allows you to print your photos in a lab of your choice. Dissatisfaction of images by labs other than those recommended or used by the photographer will not be guaranteed. The copyright refers to the creation of the images themselves. The creation of images the editing style and how they are delivered as final artwork is how they should remain. Changes to the artistic content of the photographs are a violation of the copyright and are subject to United States Copyright Laws and could impose a $300 per image violation for such alterations.  Client acknowledges that they are given the right to print the images (print rights) but not the right to change the appearance of the images (copyright). *

CANCELLATION AND RESCHEDULE - If for any reason client cancels less than 24 hours prior to the event date, they will not be rescheduled by reapplying the retainer. If clients reschedule more than 24 hours in advance, their retainer is moved to a new date. Clients wishing to reschedule more than once will be required to resubmit a retainer. All reschedules due to weather will be at no penalty to the client. No compensation will be given to clients if the photographer needs to reschedule their session for circumstances beyond the photographers control. Sessions that are cancelled and not rescheduled will not be refunded their retainer. *

OTHER RISKS - Shooting outdoors has some risks. Though the occurrence of coming into contact with animals is LOW, it's still a risk. Client understands that any contact with wildlife is unintentional and beyond the control of the photographer. Additionally with the presence of disease born ticks in Maryland, it is commonly known that being bitten can transmit illnesses. It is widely accepted in the medical community that treatment should be sought. It is our recommendation that clients follow-up with your doctor if you feel you may have been bitten. Client agrees to hold photographer harmless of unwanted contact with wildlife, ticks and or insect bites. Client understands that photographer will not supply bug repellent, and that client will be responsible for wearing or bringing it to the session to apply if they feel it is necessary. *

Symptoms of COVID-19 include: fever, cough, runny nose, Sore Throat,  Difficulty Breathing, NOTE: This list is not all-inclusive as COVID-19 has a wide range of unpredictable symptoms *

ENTIRE AGREEMENT - This agreement is the entire understanding of the parties (PHOTOGRAPHER and CLIENT). It supersedes all prior and simultaneous agreements between the parties, including verbal agreements. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, which does not mean that any other provision of this agreement is held to be invalid or unenforceable under the law, the validity of the agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect. *
