I, the undersigned, in consideration of the Dance Studio by BostonProScooter LLC, a limited liability company doing business as (DBA) Mango Studio organized under the laws of the Commonwealth of Massachusetts (the “Company”, together with its owners, members, managers, agents, independent contractors, and all other persons or entities acting in any capacity on their behalf, the “Covered Persons”), agree that my use of the Dance Studio (the “Studio”) is conditioned on understanding, acknowledging, and agreeing to each of the following: Despite precautions, the use of this Studio involves certain risks and dangers including but not limited to possible personal injury and personal property damage resulting from falling, injuries, or other unforeseen events. I acknowledge that the Company has advised me of these risks and has recommended appropriate safeguards.
By signing this liability waiver and release (the “Waiver”), I assume all such risks related to the use of the Studio. I will not hold the Covered Persons liable for any personal injury or any personal property damage that may occur as a result of the use of the Studio. I take full responsibility for the use of the Studio, in addition to any damage I may cause to the Studio. I agree to follow all rules and instructions presented by the Company’s staff members and use the Studio in a responsible manner. If I should observe any issues with the Studio before, during, or after its use, I agree to report such issues to the Company’s staff members right away. I and my family, heirs, and personal representatives release, waive, discharge, and hold harmless the Covered Persons, and agree not to sue the Covered Persons for any and all liability, claims, demands, actions, and causes of action whatsoever now and in the future arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any other person while using the Studio. I will defend, indemnify, and hold harmless the Covered Persons from any and all claims, demands, losses, damages, actions, judgments and liabilities (including attorneys’ fees) of any nature, including those by third parties, and causes of action arising out of or related to the use of the Studio.
This Waiver shall be governed by the laws of the Commonwealth of Massachusetts, which shall be the forum for any action, claim or proceeding under this Waiver. This Waiver can only be amended by a written instrument signed by me and an authorized representative of the Company. All covenants contained in this Waiver are severable, and in the event of any being held invalid by any competent court, this Waiver shall remain intact except for the omission of the invalid covenant. I will return the Studio in the same condition as it was in when the rental period began. I will be responsible for any damage caused to the Studio during the rental period.
I acknowledge that if I am the individual who reserved the Studio for the rental period (“Primary Renter”), I will be responsible to ensure this waiver is signed by any occupants who may occupy the Studio during the rental Period (“Occupant”). I understand that there will be a $20 fine imposed by the Company on the Primary Renter for any occurrence if any Occupant in the Studio is discovered to not have signed this waiver during the rental period. Any recurrent occurrence in which an occupant is occupying the Studio without signing this rental waiver in advance may result in the Primary Renter’s immediate prohibition from renting the space again.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
PARENT / GUARDIAN WAIVER FOR MINORS (Only if participant is under 18 years old) The undersigned parent and natural guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in the activity or event, and has agreed individually and on behalf of the child or ward, to the terms of the accident waiver and release of liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor, the parents, of the legal guardian.
