Terms & Conditions

If selected to popup with INLAND, the following terms will serve as the Agreement between you, the "Brand” and “INLAND”, (Inland Design Gallery Inc.) in relation to the 2024 Spring Popup taking place at the Eaton Centre. the "Venue".  The deadline to apply is April 5, 2024, however applications will be reviewed on a rolling basis.

REGISTRATION & PAYMENT - Brands are required to make full payment within 5 business days of receiving an acceptance email and invoice in order to secure a space. Holds are not provided for unpaid accounts. Registration is non-transferable. 

INLAND PROVIDES - 
Retail space with shelving and/or clothing rails, storage for extra stock, brand signage, event management, support staff and volunteers, 24-hour mall security, fittings rooms, advertising, and media relations. 

INLAND DOES NOT PROVIDE Hangers, merchandising objects, packing tissue, product packaging, shopping bags, POS system, sales staff, station setup, WIFI, or insurance.  

RETAIL HOURS Brand staff must be at the shop for the entire duration of the popup to manage sales: Thursday 10 am - 9 pm, Friday 10 am - 9 pm, Saturday 10 am - 9 pm, and Sunday 11 am - 7 pm.

LOAD-IN / OUT Load-in will take place on Wednesday, May 8, 2024 via the mall drive-up loading doc or walk up if your collection is compact. A timed entry schedule will be provided two weeks before the popup. Load out will take place on the evening of Sunday, May 12 from 7 pm to 10 pm. 

PHOTO/VIDEO RIGHTS  Brands grant INLAND a worldwide, non-exclusive, royalty-free license to reproduce and publicly promote their information, photos, and/or video (received from the Brand or captured at the popup) before, during after the popup and for all future online and offline promotional purposes.

HOLD HARMLESS The Brand agrees not to make permanent alternations to the Venue and will cover any and all expenses for alterations and damages caused by the Brand. INLAND management, staff, volunteers, partners, and the Venue will not be held responsible for any loss, costs, expenses, or damages howsoever caused, to the Brand's belongings, body, property or reputation. The Brand acknowledges that insurance coverage is not provided by INLAND or the Venue for the Brand's property or otherwise.

CANCELLATION - INLAND reserves the right to postpone or cancel the popup at any time, for any reason, and will not be held liable for non-delivery or termination. In such case, this Agreement, and any payments made, may be deferred to a later date, a new venue, or refunded in full as determined on a case-by-case basis. Brand cancellations made less than 20 prior to the popup will not be refunded. Anyone exhibiting symptoms of COVID-19 will not be permitted to enter the Venue. Covid-19 does not qualify for cancellation. In such case, replacement sales staff will need to be hired by the Brand. 

SEVERABILITY - If any part of this Agreement is held to be invalid, void, or unenforceable, the remainder of the terms shall remain in full force.
