FORM OF INDEMNITY-CUM-DECLARATION WITH UNDERTAKING
(To be executed by Student enrolled for the below mentioned course at the time of participation)
This Indemnity Bond-cum-Declaration with undertaking is executed by the undersigned who fills this form in favour of MI India.
Whereas on my application and request I have been enrolled for Part B course conducted by MI India being conducted on 30/01/2023 to 02/02/2023.
Now it is hereby declared and undertaken by me here to as follows:
(a) That I have in compliance of the requirement by MI India of necessary documents as determined by the policies of the organization MI India/McKenzie Institute International submitted the following documents mentioned hereinbelow:
(i) Passing Physiotherapy_________________________________________
(ii) College ____________________________________________________
(iii) Council/IAP Certificate ________________________________________
(iv) Any other ___________________________________________________
(v) ___________________________________________________________
(b) I declare that the abovementioned submitted documents provided by me for enrolling in the above course are true and correct and authentic and these by themselves would enable me to be on the permanent Register of the Central or State Council for Physiotherapy in India, or any such authorized body of or by the Government constituted for the purpose at any point in time.
(c) I undertake that if at any time the documents herewith submitted by me are found to be unauthentic or false or fabricated or forged or unrecognized or illegal in any manner then MI India will be entitled to take recourse to appropriate legal action against me as deemed fit and I shall be liable to prosecution of the same at my risk and cost and that I shall also be liable to indemnify MI India for any loss or expenses or injuries suffered by MI India on the account.
(d) That I am aware that the materials provided by MI India during and for the course are exclusive to their organization and subject to copyright and is an intellectual property of MI India and McKenzie Institute International collectively. I agree and undertake that I shall not indulge in any activities that will result in infringement of the exclusive copyright and intellectual rights of MI India and McKenzie Institute International and that I shall not make copies or reproduce or distribute in any manner the materials whether they be in document or text form, or PDF form or any other electronic form or any other mode of physical or virtual form that I have received in pursuit of this course from MI India.
(e) That I am aware and I undertake that in the circumstances of being an existing Credentialed McKenzie Therapist, in case of any violation or infringement by me of copyright or intellectual property regarding materials already or previously supplied to me in courses already undergone by me of MI India, even with regard to any non-legitimate non-supporting documents, my name will be immediately struck off and removed from the register of McKenzie Institute India and McKenzie Institute International websites and appropriate legal action may be initiated against me.
(f) I agree and undertake that I will not infringe the copyright or intellectual property of MI India or McKenzie Institute International in any manner. I agree that if I violate or infringe the copyright or intellectual property rights of MI India in any manner, it will be open for MI India or the McKenzie Institute International to pursue any appropriate legal action against me as deemed fit by them before the concerned authorities/courts/tribunal, etc. at my risk and cost and that I shall also be liable to indemnify MI India and McKenzie Institute International for any loss or expenses or injuries suffered by MI India or McKenzie Institute International on the account.
(g) I am aware and I agree that after due enrollment, I am obliged to and will observe and comply with all the rules and regulations and bound to the policies of the organization as set out previously thereof and that any violation thereto will invite the appropriate consequences thereof including any penalty or legal actions as determined appropriate by the organization.
(h) I undertake to not make or having made any recording in any manner through any electronic, electrical or manual device audio or visual of the course contents or methodology or course proceedings or lectures of the course sessions in part or wholly or reproduce or replicate them in any manner elsewhere in part or wholly. I undertake and agree that in violation of the same, I shall be liable for appropriate legal action at my risk and cost and that I shall also then compensate and indemnify MI India for any loss or expenses or injuries suffered by MI India.
(i) I am aware and I agree that the organization can, at any time, in the interest of the MI India, have me removed from the course if in the organization’s sole discretion I violate the discipline required to be observed or have been found to violate any terms of the course being conducted or indulged in any practice not permitted by the organization or/and is detrimental to the interest of the other course participants or the organization in any manner or for the smooth conduct of the course.
(f) That I agree that no fees, partial or full, will be refunded to me in the case of any violation of the terms, conditions and policies of MI India.
(g) That MI India will not be liable for any damages/charges on account of any injuries, minor, grievous or fatal or otherwise, which may be sustained by me at any time during the pursuit of the abovementioned course within or outside the premises of the conduct of the course. I agree that all expenses that may be incurred in the treatment of such injuries shall be borne by me as per the organization’s rules.
