Hershe St. Community Garden/Fifth Ward Pocket Prairie Waiver of Liability

We hope your gardening experience is safe and rewarding, but accidents can happen. The
following waiver must be signed by all volunteers to protect Progressive Fifth Ward Community Association from liability.

I am under the age of age of 18 and therefore will need the signature of my legal guardian, parent, chaperone or representative to make this waiver legally binding.
Clear selection
In consideration of being permitted to participate in any way at Hershe St. Community Garden and Fifth Ward Pocket Prairie, I, for myself, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to sue Progressive Fifth Ward Community Association or its officers, volunteers and agents from liability from any and all claims resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation at Hershe St. Community Garden and/or Fifth Ward Pocket Prairie. *

I also agree to INDEMNIFY AND HOLD Hershe St. Garden and Fifth Ward Pocket Prairie and its employees, volunteers and agents HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement in the Fifth Ward Pocket Prairie &  Hershe St. Community Garden and to reimburse them for any such expenses incurred. *
