1950년 7월 7일, 유엔안보리는 결의84호(S/1588)를 채택하여 미국이 이끄는 ‘통합사령부’ 설립을 회원국들에 권고했으나, 미국은 안보리 결의를 위반하고 “유엔사령부”를 설치했다.

1994년 부트로스 부트로스-갈리 유엔사무총장이 명확히 했고, 2018년 9월 로즈마리 디칼로 유엔사무차장이 안보리에서 재확인했듯이 소위 “유엔사”는 “유엔의 활동도 전문기구도 아니며 유엔의 지휘‧통제 하에 있지도 않다.”

더구나, 안보리 결의84호 채택 자체가 소련의 “동의투표”가 없었기에 유엔헌장 위반이자, 유엔상징과 깃발에 대한 총회결의와 1947년 12월 19일 첫 유엔깃발법의 위반이었다.

1975년 11월 18일, 유엔총회는 ‘“유엔사령부”를 해체할 필요가 있다’는 결의3390B를 채택하여 유엔이름의 남용을 막기 위한 담대한 조치를 취했다.

더욱이, 1953년 정전협정, 1970년 말 미국을 제외한 모든 외국군의 한국철수, 1991년 남북한 유엔동시 가입을 통해 안보리결의84호의 목적이 이미 달성되었기에, 미국은 진즉에 “유엔사”를 해체했어야 했다.

그러나, 미국은 이 가짜 기구를 해체하는 대신, 한국에 수 십억불의 미국 무기수입을 강요하며, 북한에 대한 전쟁을 지속하기 위해서, 최근에는 죽어가던 “유엔사”를 부활시키려 하고 있다.

게다가, 2018년 미국은 비무장지대를 통과하는 철도‧도로망 연결 같은 남북개발사업을 막기 위해서 남측 비무장지대의 관할권을 강변하고 “유엔사”의 임무를 확장했다.

 이같은 퇴행적 움직임은 한반도에서 종국적인 평화와 화해, 협력, 발전을 위해 뛰고 있는 한국민의 강렬한 열망에 반하는 새로운 장애물이다.

따라서, 우리는 한국민의 평화와 정의에 대한 권리를 지지하는, 관심있는 개인과 단체로서, 가짜 “유엔사”의 신속한 해체를 촉구하는 이 선언서에 서명한다.
 

1. 소위 “유엔사”는 유엔의 전문기구도 보조기구도 아니다.

2. 미국은 가짜 "유엔사"의 유엔기 사용을 중지하라.

3. 미국 통제 하의 주한“유엔사”와 주일“유엔사-후방”을 즉시 해체함으로서 유엔이름의 남용을 중단하라.

4. 미국은 “유엔사” 해체와 “한국정전협정을 평화협정으로” 교체할 것을 촉구한 1975년 유엔총회결의를 이행하라.

5. 모든 유엔회원국과 시민단체들을 포함한 국제공동체는 유엔의 이름과 존엄을 수호하기 위하여 가짜 “유엔사”와의 모든 협력을 거부하고, 현혹된 실체의 종료를 앞당길 의무가 있다.
 
6. 가짜 “유엔사”의 조기 해체는 남북정상 합의의 이행과 한국전쟁의 공식적인 종결과 한국민의 완전한 자결권 행사와 국제적 차원의 유엔법과 국제법 발전에 기여할 것이다.

On July 7, 1950, the UN Security Council (SC) recommended, in its Resolution 84 (S/1588), the creation of a U.S.-led “Unified Command,”(“UC”) but the United States soon established another entity called the “United Nations Command” (“UNC”), in violation of the SC Resolution.
    As it was clarified by the UN Secretary-General Boutros Boutros-Ghali in 1994, and confirmed again by the UN Under-Secretary-General Rosemary DiCarlo at a SC meeting in September 2018 that the so-called “UNC” is “not a UN Specialized Agency  or Subsidiary organ  nor does it come under the command and control of the UN.”
    Furthermore, SC Resolution 84 itself was adopted in violation of the UN Charter (without “concurring votes” of the USSR), the General Assembly Resolutions on UN emblem and flag, and the first UN Flag Code (December 19, 1947). In particular, the SC had no authority to authorize a non-UN entity, such as the UC, to use the UN flag in its military operations.

     On November 18, 1975, the UN General Assembly (GA) took a bold step to stop the abuse of the UN name by adopting its Resolution A/RES/3390B, which stated that “it is necessary to dissolve the ‘United Nations Command.’”
     Moreover, the U.S. should have terminated the “UNC” long time ago in any case, since the main purpose of the SCR 84 had been achieved with the Korean military cease-fire agreement in 1953 and the withdrawal of all foreign troops, except the U.S., from Korea by the end of 1970s, and the subsequent entry of both Koreas (ROK and DPRK) into the United Nations as official Member States in 1991.
    However, instead of dissolving the fake entity, the U.S. Government has been trying in recent years to revive the moribund “UNC” so that it could continue its endless war against North Korea, while forcing the ROK Government to buy billions of dollars of new U.S. weapons.

     In addition, the U.S. quibbled about its jurisdiction over the southern part of the DMZ and expanded the mission of “UNC” in 2018, to block the inter-Korean development projects, such as connecting a network of the railroads and roads across the DMZ.
     These reactionary moves are creating new obstacles against the strong aspirations of the Korean people to work for a lasting peace, reconciliation, cooperation, and development in Korea.

    Thus, as concerned individuals or organizations, we sign this declaration calling for a prompt dissolution of the fake “UNC,” in support of the Korean people’s rights to peace and justice.

 
1. The so-called “UNC” is neither a subsidiary body nor an agency of the United Nations.

2. The U.S. should stop the illegal use of the UN flag by the “UNC.”

3. The U.S. should stop abusing the name of the United Nations by promptly dissolving the U.S.-controlled “UNC” in Korea and “UNC-Rear” in Japan.
4. The U.S. should implement the 1975 UN GA resolution, calling for dissolution of the “United Nations Command” and replacement of the “Korean Military Armistice Agreement with a peace agreement.”

5. The international community, including all UN Member States and civil society groups, has responsibility to refuse all cooperation with the fake “UNC” and work for an early termination of the misleading entity in order to protect the UN name and dignity.

6. An early termination of the fake “UNC” will also contribute to a full implementation of the inter-Korean summit agreements, an official ending of the endless Korean War, full exercise of self-determination by the Korean people, and the advancement of UN law as well as international law in the world.
