Application into Pink Lightning Dragon Boat Team accepted after satisfactory review by the Pink Lightning Board. Only applications with:  a) submission of Pink Lightning Membership Application and Waiver of Liability;  b) completion of online New Jersey Dragon Boat Club (NJDBC) Membership Application, Waiver and Release of Liability, and Paddler Agreement forms; and c) payment of $200 to NJDBC, will be considered for membership.

I hereby give Pink Lightning permission to use any photographs, motion pictures, recordings, and/or likenesses, which may be edited disseminated, adapted, modified, copied, used, exploited in whole or in part in all media and formats throughout the world in perpetuity for any legitimate commercial or non-commercial purpose, including but not limited to promoting, advertising, and marketing, in print, on websites, or other mediums, without prior notice or compensation.
ASSUMPTION OF RISK, RELEASE, AND WAIVER OF LIABILITY AGREEMENT *
Acknowledgement of Risk. I hereby acknowledge and agree that participation in Pink Lightning Dragon Boat Team’s (herein known as Pink Lightning) practices and activities comes with risks that cannot be eliminated without jeopardizing the essential qualities of the activity (“inherent risks”). I expressly agree and promise to accept and assume all of the risks existing in this activity. I have full knowledge and understanding of the inherent risks associated with my participation with Pink Lightning, including but in no way limited to: (1) slips, trips, and falls, (2) aquatic injuries, (3) drowning, (4) athletic injuries, and (5) illness, including exposure to and infection from viruses or bacteria. I further acknowledge that the preceding list is not inclusive of all possible risks associated with participation in Pink Lightning practices and events and that said list in no way limits the operation of this Agreement. In consideration for being permitted to utilize the services and activities of Pink Lightning, I will comply with all Pink Lightning policies and rules and accept they may be altered by Pink Lightning at any time.

COVID *

Coronavirus/COVID-19 Warning and Disclaimer. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. Evidence has shown COVID-19 can cause serious and potentially life-threatening illness and even death. Pink Lightning has put in place preventative measures to reduce potential spread of COVID-19 but cannot guarantee you or your family will not be exposed, contract, or spread COVID-19 because the possibility of the presence of the disease cannot be eliminated. Therefore, if you choose to attend Pink Lightning practices and activities, you could increase your and your family’s risk of contracting or spreading COVID-19. By signing this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily accept the risk that you and/or your family may be exposed to, or infected by COVID-19 when participating in Pink Lightning practices and activities, and that such exposure or infection may result in personal injury, illness, permanent disability, or death. You also acknowledge the risk of becoming exposed to, or infected by, COVID-19 while participating in Pink Lightning events may result from the actions, omissions, or negligence of you and others, including, but not limited to Pink Lightning and NJ Dragonboat Club members, volunteers, and program participants and their families. 

Waiver *

WAIVER OF LAWSUIT/LIABILITY. I AGREE TO RELEASE AND ON BEHALF OF MYSELF, MY HEIRS, REPRESENTATIVES, EXECUTORS, ADMINISTRATORS, AND ASSIGNS, HEREBY DO RELEASE PINK LIGHTNING, ITS OFFICERS, TRUSTEES, EMPLOYEES, VOLUNTEERS, AGENTS, REPRESENTATIVES AND INSURERS (RELEASEES) FROM ANY CAUSES OF ACTION, CLAIMS, OR DEMANDS OF ANY NATURE WHATSOEVER INCLUDING, BUT IN NO WAY LIMITED TO, CLAIMS OF NEGLIGENCE, ACTIVE OR PASSIVE, WHICH I, MY HEIRS, REPRESENTATIVES, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE, NOW OR IN THE FUTURE, AGAINST PINK LIGHTNING ON ACCOUNT OF PERSONAL INJURY, PROPERTY DAMAGE, DEATH OR ACCIDENT OF ANY KIND, ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF PINK LIGHTNING’S PRACTICES AND EVENTS ON OR OFF-WATER WHETHER THAT PARTICIPATION IS SUPERVISED OR UNSUPERVISED, HOWEVER THE INJURY OR DAMAGE OCCURS, INCLUDING, BUT NOT LIMITED TO THE NEGLIGENCE OF RELEASEES. 

Severability. The provisions of this Agreement are severable, and if any provision is found to be unenforceable, the other provisions shall remain fully valid and enforceable. This Agreement shall survive the termination of any arrangement contained herein.

Waiver of Likeness.  I hereby give Pink Lightning permission to use any photographs, motion pictures, recordings, and/or likenesses, which may be edited disseminated, adapted, modified, copied, used, exploited in whole or in part in all media and formats throughout the world in perpetuity for any legitimate commercial or non-commercial purpose, including but not limited to promoting, advertising, and marketing, in print, on websites, or other mediums, without prior notice or compensation.

Governing Laws. This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey; any and all disputes under and/or related to this Agreement shall be resolved first by either binding arbitration or mediation by a mediator or arbitrator selected by Pink Lightning, and in the event that the dispute is unable to be resolved by the former, it shall be resolved in a Court of the State of New Jersey, in Morris County. In the event of a dispute respecting this Agreement, the prevailing party is entitled to reasonable attorney’s fees and costs. 

Waiver of Jury Trial. Each party hereby irrevocably waives its rights to trial by jury in any Action or proceeding arising out of this Agreement or the transactions relating to its subject matter.


Entire Agreement *

This membership Agreement constitutes the entire understanding and agreement between the parties. No changes alterations, modifications or qualifications to the terms hereto shall be binding unless in writing and signed by both parties. This Agreement supersedes any and all other agreements previously made between Pink Lightning and Member, whether oral or written.

I have carefully read, fully understand, and agree to all the terms of this Assumption of Risk, Release and Waiver of Liability Agreement.
