LAKE FOREST HIGH SCHOOL DISTRICT 115 FALL – 2021 FUTURE SCOUTS BOYS BASKETBALL 5TH-8TH GRADE CLINIC WAIVER of LIABILITY, ASSUMPTION of RISK and HOLD HARMLESS relating to COVID 19PLEASE COMPLETE THIS WAIVER ONE TIME FOR EACH PARTIIPANT:The IHSA has recently released a plan with considerations with preventative measures to reduce the spread of COVID-19. However, Lake Forest High School District 115 cannot guarantee that you or your child will not become infected with COVID-19. Further, participating in District 115 athletic activities could increase your risk and your child’s risk of contracting COVID-19. Participant Liability Waiver, Assumption of Risk and Hold Harmless Agreement Please read this form carefully and be aware that by registering for and participating in this program(s) or by registering your minor child/ward for participation in this program(s), you acknowledge the contagious nature of COVID-19.You will be waiving your rights and/or the rights of your minor child/ward to all claims for injuries you or your minor child/ward might sustain arising out of this program(s), voluntarily assuming the risk that your child and you may be exposed to or infected by COVID-19 and you will be required to indemnify, hold harmless, and defend Lake Forest High School District 115, its Board of Education and its members, its officers, employees, agents, volunteers and representatives. Risk of Injury - “As a participant in the program, or as a parent or legal guardian of a participant under 18 years of age, I recognize and acknowledge that there are certain risks of exposure to COVID-19 that may result in personal injury, and I agree to voluntarily assume the full risk of injuries, including illness, permanent disability, death, damages, or loss which I or my minor child/ward may sustain as a result of participating in any and all activities associated with this program.”“I understand that the risk of becoming exposed to or infected by COVID-19 by participating in the District 115 Fall 2021 Athletic Activities may result from the actions, omissions, or negligence of myself and others including, but not limited to, District 115 employees, volunteers, agents and program participants and their families.” COVID-19 - “As a participant in the program, or as a parent or legal guardian of a participant under 18 years of age, I recognize and acknowledge that this activity has associated risks regarding the exposure to COVID-19. By participating in this activity, the undersigned acknowledges he or she may be increasing the risk of contracting the virus. The undersigned also understands that there are potential risks that may presently be unknown. Because of the dangers of participating in this activity, the undersigned recognizes the importance of complying, and agrees to fully comply, with the applicable laws, policies, rules, and regulations, and any supervisor’s instructions regarding participation in this activity, including instructions related to social distancing precautions, wearing face coverings, physical separations, and sanitization.”Waiver of Injury Claims - “I agree to waive and relinquish any and all claims I or my minor child/ward may have arising out of, connected with, or in any way associated with the District 115 Fall 2021 Athletic Activities.”Release from Liability - “I do hereby fully release, covenant not to sue, hold harmless and discharge the Lake Forest High School District 115, its Board of Education and its members, officers, employees, agents, volunteers and representatives from any and all claims from injuries, including death, damage or loss which I or my minor child/ward may have or which may occur on account of participation in the District 115 Fall 2021 Athletic Activities.”Indemnity and Defense - “I further agree to indemnify, hold harmless and defend the Lake Forest High School District 115, its Board of Education and its members, officers, employees, agents, volunteers and representatives from any and all claims from injuries, including death, damages and losses sustained by me or my minor child/ward and arising out of, connected with, or in any way associated with the District 115 Fall 2021 Athletic Activities. I understand and agree that the foregoing includes any claims from the actions, omissions, or negligence of any indemnitees, whether a COVID-19 infection occurs before, during or after participation in the District 115 Fall 2021 Athletic Activities.”In the event of any emergency, I authorize the Lake Forest High School to secure from any licensed hospital, physician, and/or medical personnel any treatment deemed reasonable and necessary for me or my minor child/ward’s immediate care and agree that I will be responsible for payment of any and all medical services rendered.I have read and fully understand and agree to the above Participants Liability Waiver and Hold Harmless Agreement.
